蠶種製造條例

Businesses that manufacture silkworm seed must comply with this ordinance.

製造原蠶種的蠶兒原則上應採用一蛾育；經商品檢驗局或省（市）主管機關許可者，可以變更，但最多只能到三蛾育。

蠶種製造者在製造原蠶種時，應使用純粹種及固定種。

This provision specifies which production methods may be used for original silkworm seed and ordinary seed, and limits the use of loose eggs.

原蠶種和普通種都要接受指定部位的檢查；經核准後，得改為抽查。被檢查的蠶卵、蠶兒、蠶蛹、蠶繭及母蛾不得以其他同類項目掉換。

This provision sets toxicity-rate standards for different silkworm moth categories and says when they are qualified, unqualified, or must be rechecked.

蠶種製造者在冷藏蠶種時，應將蠶種儲存在領有許可證的冷庫或冰庫。

The provincial or municipal silk-industry supervisory office or代理機關 must send staff to inspect silk seed manufacturing plants and report the inspection results to the Ministry of Economic Affairs.

Foreign-imported silkworm seed may be sold or transferred only after passing inspection by the Commodity Inspection Bureau.

經濟部可以用命令限制外國輸入的蠶種。

經檢查合格的蠶種要貼上合格證並加蓋指定印信；沒有合格證或未加蓋印信的，不准銷售或讓與。

蠶種製造者申請蠶種製造場許可證時，須提出列明事項，繳納證書費及印花稅，並依所在地機關查明後轉呈經濟部核發。

檢查不合格的蠶種，應予焚燬。

蠶種製造者每年要把所製蠶種的品種名、化性和製造額數分別填註，並由商品檢驗局或省（市）主管機關轉呈經濟部備案。

以試驗研究為目的的蠶種製造，不受本條例限制，但要備具指定資料，經商品檢驗局或地方主管機關轉送經濟部備案。

Specified officials may not invest in the business of manufacturing silk seed, and may not also serve as employees of a silk seed manufacturing plant.

檢查蠶種製造場時，如果查核人員與該場主辦人員有親屬關係，應迴避。

未經經濟部核發許可證而從事製造的業者，會被罰鍰，且不得出售蠶種；如果蠶種已出售，還要退還售價並另罰相當於售價的罰鍰。

If someone violates specified provisions, they may be fined up to 30 yuan; the relevant silkworm goods may be confiscated, and the permit may also be revoked if the same situation happens twice or more.

If a person violates Article 17 or Article 19(1), the person must return the silkworm seed sale price and is fined an amount equal to that sale price.

If a person violates Articles 4, 7, 8, 9, or 15, their business is stopped; if the violation is later corrected under the relevant article, that disposition must be revoked immediately.

A person who violates Article 20 may be fined up to 50 yuan and may also have their permit revoked.

各省（市）主管機關可以先呈准經濟部後，設立蠶業監管所或代理機關，負責蠶種監管事宜。

蠶種製造者把合格證讓他人使用，或有人使用失效的合格證，會被處以合格證費十倍的罰鍰，並可能被撤銷許可證。

購買蠶繭用來製造蠶種的人，會被處五十元以下罰鍰，並可能被撤銷許可證；相關蠶繭、蛾口繭及已製成的蠶種也會被沒收。

If any of the listed acts occurs, a fine of up to 50 yuan may be imposed, the silkworm seed will be confiscated, and the permit may also be revoked.

Specified officials must be disciplined if they violate Articles 23 or 24 of the statute.

經濟部有權訂定本條例施行細則。

This provision says the条例 takes effect on the day it is promulgated.

蠶種製造的主任技術員必須具備列出的三種資格之一。

蠶種製造者只能使用原蠶種；其每年所製蠶種的原種品種及交雜方式，須由商品檢驗局或各省（市）主管機關呈准經濟部後指定。

蠶種製造原則上應在春、秋兩期進行；夏期製種則可由各省（市）視實際情況呈請經濟部核定。

Silkworm seed manufacturers must have the equipment needed to prevent silkworm diseases.

蠶種製造者應對蠶室、蠶具及製種用具等進行消毒。

原蠶種原則上只能由中央或省（市）蠶業機關製造；其他蠶種製造場在審查合格並經經濟部核准後，才可以製造。
