糧食管理法

This law is established to regulate food supply and demand, stabilize food prices, improve food quality, and protect producers’ and consumers’ interests.

經營糧食業務前，須先向主管機關辦理糧商登記；但兼營小規模糧食零售業且每日庫存在主管機關規定數量以下者，不受此限制。

糧商要記錄糧食購進、售出、存儲、加工、經紀等資料；進口糧食要與國產糧食分開記錄。

主管機關在天然災害或突發事變導致糧食供需失調或有失調之虞時，應報請行政院核備後，公告管理相關糧食措施。

主管機關應輔導優良品質稻米的產銷，並建立稻米分級檢驗制度。

Market-sold packaged grain must be clearly labeled in Chinese and standard symbols with specified items; market-sold bulk grain must be labeled in Chinese with product name and origin.

Food sold in the market must not be mislabeled, mixed with adulterated or counterfeit content, falsely advertised on packaging or containers, or sold by mixing imported and domestic rice.

主管機關可以抽查市場上銷售糧食的標示並檢驗品質；糧商及特定小規模糧食零售業者不得規避、妨礙或拒絕，且要提供糧食來源資料。

任何人不得故意散播會影響糧食交易價格或妨礙主管機關執行糧食產銷、收購公糧計畫的謠言或不實訊息。

This article is deleted.

Anyone who violates the competent authority’s management rules announced under Article 12 may be punished with up to three years’ imprisonment, detention, or a fine up to the total grain price, or both.

違反糧商登記、記錄保存或標示規定者，主管機關應先命限期改正；屆期未改正的，會被罰鍰，情節重大者還可能被停止部分或全部業務，甚至廢止登記。

This provision sets administrative fines and further sanctions for violations related to grain-business recordkeeping, inspections, and supply-source information.

Certain grain merchants or related organizations barred from reapplying for one year after revocation; the authority may publicize violations, and serious consumer-harm cases require product removal and recall, with fines or stronger sanctions for noncompliance.

違反第十五條之一，且足以損害農民收益或消費者權益的，會被罰新臺幣六萬元以上三十萬元以下。

For this Act, the competent authority is the Council of Agriculture, Executive Yuan.

主管機關在受理本法下的登記和檢驗時，應收取登記費及檢驗費；收費標準由主管機關訂定。

主管機關應調查主要糧食生產、消費、成本與價格，並建立農戶耕地資料；農戶也要申報實際耕作人與耕作紀錄。

糧食原則上可自由輸出、輸入，但為國家糧食安全，主管機關得公告限制；受限制的糧食在輸出、輸入前要先取得同意。

主管機關可以委由公糧業者辦理公糧的經收、保管、加工及撥付；相關條件與管理辦法由主管機關訂定。

Public rice received for inspection must be checked for impurities, moisture, bulk weight, and quality; the inspection standards are set by the competent authority.
