肥料管理法

This provision states that the law is enacted to improve fertilizer management, maintain fertilizer quality, sustain soil fertility, increase agricultural productivity, and protect the environment.

肥料業者在歇業、停業、復業或登記事項變更後，應在30日內向原發證機關提出登記證及相關文件辦理。

申領肥料登記證或辦理有效期間展延時，都要繳納證照費；費用金額由中央主管機關決定。

Fertilizer must be packaged and labeled before it may be sold or distributed, except for domestically produced compost transported directly from a factory or plant to farmland for application.

肥料標示必須以中文記載法定事項。

Fertilizer manufactured or imported must meet the law’s quality requirements, and the standards inspection authority may inspect it.

輸入含有動物、植物有機質成分的肥料，必須符合動物、植物檢疫規定。

國內製造、專供輸出的肥料，原則上要標註產地；其品目、規格、包裝或標示，還可以依國外買方要求，不受第4條及第13條限制。

販賣或意圖販賣而陳列、貯藏的肥料，不得拆封、分裝、摻雜、稀釋或改動肥料標示；肥料製造業及輸入業者在製造、加工、分裝時不在此限。

If fertilizer falls into any listed category, it must not be sold, displayed for sale, or stored for sale.

Anyone publishing fertilizer advertisements must state the fertilizer registration certificate number, product type, and registered ingredients, and must not use false, exaggerated, or otherwise improper advertising.

This provision defines the competent authority under the Act for central, municipal, and county/city levels.

不符合中央主管機關依第四條公告肥料規格的物品，不得以肥料名稱或具有肥料效果進行標示、廣告或宣傳。

肥料製造業者和輸入業者 must 記錄各項肥料的製造或輸入、銷售及庫存數量，並將記錄文書保存三年。

主管機關得進入肥料相關場所查驗並抽樣；業者不得規避、拒絕或妨礙，且查驗人員執行查驗時應出示身分證明文件。

被查獲涉嫌違規且需要抽樣鑑定的肥料，應先封存，並由肥料業者具結保管。

If the certificate authority finds false, altered, or untrue supporting documents after issuing a fertilizer registration certificate, it must revoke the certificate. If the operator has violated certain provisions and been penalized more than twice within one year, the authority must abolish the certificate. In either case, the operator may not reapply for the certificate for two years.

如果已核准登記的肥料被證實會危害土壤、植物或國民健康，中央主管機關要禁止其製造、輸入並廢止肥料登記證；業者還要依規定回收市售品並處理庫存品。

發證機關應定期公告肥料登記證的核發、有效期間展延、註銷、撤銷或廢止。

違反前條第一項而製造或輸入肥料者，會被處新臺幣10萬元以上50萬元以下罰鍰；經通知限期停止而不從的，還可能自通知日起按日連續處罰。

Violations of the listed fertilizer rules can be fined NT$50,000 to NT$250,000.

違反列舉的肥料標示、樣品標示或販賣贈與、以及特定條文規定者，可能被處新臺幣3萬元以上15萬元以下罰鍰。

This article defines key terms used in the fertilizer law.

If any listed violation occurs, the person is subject to a fine of NT$20,000 to NT$100,000.

本法規定的罰鍰由主管機關處罰。

逾期未繳納的罰鍰，會移送法院強制執行；在未繳清結案前，停止受理該業者申請肥料登記證。

農戶或家庭自製、供自用且沒有販賣的有機質肥料，不適用本法規定。

Certificates issued before this law takes effect must be exchanged by the date announced by the central competent authority.

中央主管機關負責訂定本法施行細則。

This law takes effect on the date it is promulgated.

中央主管機關負責訂定並公告肥料的種類、品目及規格。

Fertilizer may not be manufactured, imported, or sold unless an application is approved by the central competent authority and a fertilizer registration certificate is issued.

經中央主管機關核准的肥料樣品，若是供研究、試驗或辦理登記用，可不受前條第一項限制；其包裝或容器上必須標示「樣品」，且不得販賣或贈與。

A fertilizer registration certificate must list specified information.

肥料登記證有效期間為四年；若到期後還要繼續製造、輸入或販賣，應在到期前六個月內向原發證機關申請展延，且每次展延不得超過四年。

If a fertilizer registration certificate is lost or damaged, an application for replacement or reissue must be made within 30 days, with reasons stated, to the original issuing authority, and the original certificate must be surrendered or cancelled by announcement.
