有機農業促進法

This provision states the law’s purpose: to protect water and soil resources, the ecological environment, biodiversity, animal welfare, and consumer rights, while promoting environmentally friendly agriculture and sustainable resource use.

主管機關應研發有機農業科技、提供資訊與人員培訓；並應鼓勵所屬人員參加相關教育訓練。中央主管機關並應參與國際組織及國際合作，進行資訊、技術與人員交流。

經營認證業務的機構或法人，要先向中央主管機關申請許可並取得許可證明文件，才能開始或變更後繼續經營。

經營驗證業務的機構、學校或法人，必須先經認證機構認證合格並取得認證證書，才能開始營業。

驗證機構與農產品經營者可以約定驗證範圍；中央主管機關也可以公告驗證收費上限。

中央主管機關可以公告認證契約和驗證契約中應記載或不得記載的事項。

主管機關應公告有機產品可使用的物質；農產品經營者不得使用禁用物質，並須確保其有機產品不含這些物質。

經驗證合格的農產品，才能用「有機」名義販賣、標示、展示或廣告；經有機轉型期驗證合格者，才能用「有機轉型期」名義。

Imported agricultural products may be sold, labeled, displayed, or advertised as organic only if they meet one of the listed verification conditions.

有機農產品及有機轉型期農產品的容器或包裝，必須以中文和通用符號清楚標示指定資訊；標示內容變更時，三個月內要更換原標示。

賣散裝有機農產品或有機轉型期農產品時，農產品經營者要在陳列販賣處以告示牌標示品名和原產地（國），並展示驗證證書影本；符合特定進口條件者，還要展示同意文件影本。

This provision defines who counts as the competent authority under the Act.

Only agricultural products verified under this law may use the organic agricultural products label.

For agricultural advertising using “organic” or “organic transition period” claims, the advertiser must keep the advertiser’s identity and contact and content records for six months, and must not evade, obstruct, refuse, or give false information if the authority asks for them.

主管機關得派員持證進入相關場所或運輸工具，進行檢查、抽樣檢驗，並可要求農產品經營者提供資料或紀錄；任何人不得規避、妨礙、拒絕或提供不實資料、紀錄。

中央主管機關辦理有機農產品及有機轉型期農產品檢驗時，原則上要依中央衛生福利主管機關依食品安全衛生管理法所定的檢驗方法；若尚未訂定，也可以採用國際間認可的方法。

農產品經營者若對檢驗結果有異議，可在收到通知後15日內、繳費後，向原抽樣檢驗機關申請複驗，且只能一次。

If certain organic products contain banned substances or otherwise fail to comply with the Act, the competent authority may order the operator or owner to stop movement, remove them from sale, recall them, or take other suitable action.

主管機關在查獲檢舉案件後，應保守檢舉人身分資料秘密，並應給予獎勵。

If either listed situation occurs, a fine of NT$600,000 to NT$60,000,000 may be imposed.

經營驗證業務而未先取得認證機構認證合格及認證證書者，會被處以新臺幣30萬元以上、3,000萬元以下罰鍰。

If someone uses an organic agriculture label without verified qualification, or ignores an order to stop using the label, they can be fined NT$200,000 to NT$2,000,000 and fined repeatedly for each violation.

This provision defines key terms used in the law, including agricultural products, organic agriculture, organic products, certification bodies, verification bodies, and labeling.

有下列違規情形之一者，主管機關可處新臺幣10萬元以上100萬元以下罰鍰，並得按次處罰。

農產品經營者若違反列舉的有機農產品規定，可能被處新臺幣6萬元以上60萬元以下罰鍰，並可按次處罰。

農產品經營者如有列舉的標示、展示或標章使用違規，主管機關應命其限期改正；逾期未改正的，還可處新臺幣3萬元以上30萬元以下罰鍰，並可按次處罰。

Accreditation bodies can be warned, suspended from taking new applications, and in repeat cases have their permit revoked; contracts may then transfer to the central competent authority.

If an agricultural product advertisement involves products covered by Article 31 or 32, the advertiser may be ordered to run a correction ad or the commissioned advertiser may be ordered to stop the ad and recall the ad materials.

If one of the situations in Articles 29 to 32 applies, the authority may publish the violation details and related identifying information.

This provision allocates penalty-imposing authority: the central competent authority handles penalties for certification and verification institutions, while municipal and county/city competent authorities handle other penalties under the Act.

中央主管機關應在一定條件下廢止已公告的有機同等性認可；但在廢止生效前已經審查合格輸入的農產品，之後仍可用有機名義販賣、標示、展示或廣告。

Existing organic certification bodies are treated as approved under this Act for 18 months after the Act starts, and may continue certification work. Existing certified organic products are also treated as certified under this Act during that 18-month period if their certificates have not expired.

在沒有本國機構、學校或法人擔任相關機構時，中央主管機關可以公告自行或指定機構、法人，於一定期間擔任認證機構或驗證機構。

主管機關應推廣有機農業，並推廣採用農藝、生物、機械與天然資源的生產管理方式，且排除合成化學物質及基因改造生物及其產品的使用。

Unless this Act says otherwise, the rules on organic agricultural products under the Agricultural Products Production and Certification Management Act stop applying when this Act takes effect.

本法的施行細則由中央主管機關訂定。

This law takes effect one year after promulgation.

中央主管機關要設任務編組、諮詢相關意見，並每四年提出有機農業促進方案，送行政院核定後實施。主管機關也要為推廣有機農業編列預算、定期檢討調升幅度，並依比例原則訂定獎勵及補貼辦法。

地方主管機關應逐年檢討並推動設置有機農業促進區，公有土地或國營事業土地可供農業使用者應優先設置，並優先輔導或補助相關基礎與產銷設施。

主管機關可以協助並獎勵有機農業相關事項；承租公有土地或國營事業土地作有機農業使用的農產品經營者，應給予租金優惠，符合條件者還可取得10至20年的租期保障。

主管機關應設置網路平臺，整合相關有機農業資訊，供公開查詢。

主管機關應輔導相關機關、團體或企業優先採用在地有機農產品，並協助成立農民市集及網路資訊平臺，讓有機農產品有更多銷售與直購管道。
