森林法

This provision states the law’s purpose: to conserve forest resources, promote public and economic benefits from forests, and protect trees with preservation value and their growing environment.

If a forest falls within certain risk categories, the competent authority must restrict logging.

主管機關可視森林所在地情況，指定特定地點與期間，限制或禁止採取或採掘草皮、樹根、草根。

國有林由中央主管機關分區管理經營；公有林由所有機關或受託法人管理經營；私有林由私人經營。中央主管機關也可依林業特性訂定並實施森林經營管理方案。

Forest management must coordinate with watershed protection and management; the Executive Yuan sets the implementing regulations.

各國有林事業區的經營計畫，由各管理經營機關擬訂後，報中央主管機關核定後實施。

本條授權中央機關訂定國有林林產物處分與管理規則，並規定天然災害後漂流到國有林區域外的國有林竹木，當地政府應在一個月內清理註記；逾期未完成時，當地居民得自由撿拾清理。

主管機關負責劃定範圍內森林區域的管理經營，並由行政院訂定前項配合辦法。

森林遊樂區可以收取環境美化及清潔維護費，遊樂設施也可以收取使用費；相關設置管理辦法與收費標準由中央主管機關訂定。

為維護森林生態與生物多樣性，森林區域內可以設置自然保護區，並可依資源特性管制人員及交通工具進出。

營林面積達五百公頃以上的公有林或私有林，應由林業技師擔任技術職務；造林業及伐木業者，則都應配置林業技師或林業技術人員。

林業經營者在有合作經營需要時，可以依合作社法組織林業合作社，並由當地主管機關輔導。

This article defines which authority counts as the competent authority under the Act, depending on location.

森林所有人要先與土地或水流工作物的所有人／權利人協商；協商不成時，報請主管機關調處，調處不成由主管機關決定。

主管機關得指定森林所有人或利害關係人，在特定林業用地內限期完成造林及必要的水土保持處理。

If national, public, or private forest land falls within any listed protective purposes, the central competent authority must designate it as protection forest.

If hills, mountains, or other land fall within any of the situations in the preceding article, they must be designated as protection forest land.

保安林的經營以社會公益為目的；各類保安林應依其特性合理經營、撫育、更新，並以擇伐為主。

中央主管機關可以核准解除保安林的一部或全部，且其審核標準由中央主管機關訂定。

符合條件的人可以申請保安林的編入或解除；一般先向直轄市、縣（市）主管機關申請，再層報中央主管機關核定。

主管機關在受理申請或依職權辦理保安林編入、解除時，應通知相關所有人並公告；公告後到第二十九條第二項公告前，編入保安林的森林未經核准不得開墾或砍伐竹木。

對保安林編入或解除有異議的直接利害關係人，可以在公告日起30日內向當地主管機關提出意見書。

地方主管機關要把保安林編入或解除的相關文件送中央主管機關核定；若有異議，還要附上異議人的意見書。

This provision defines “forest” and classifies forests by ownership into state-owned, public, and private forests.

Matters about protecting trees outside forests are handled under Chapter 5-1.

未經主管機關核准或同意，不得在保安林內伐採、傷害竹木、開墾、放牧，或採取、採掘土石草皮樹根。

Cutting bamboo or trees in protected forests is prohibited. Landowners or bamboo/tree owners may claim compensation limited to direct damage, and the central government compensates those damages, though specially benefited persons may be ordered to bear all or part of the cost.

森林保護可以設置森林警察；如果沒有設置，當地警察要代行森林警察職務。

森林外緣可以設置森林保護區；主管機關負責劃定，並層報中央主管機關核定後，由當地主管機關公告。

In forest areas and forest protection areas, fire is generally prohibited. Permission from the competent authorities creates an exception, and adjacent forest owners or managers must be notified first.

主管機關應視森林狀況設置森林救火隊，並可按需要編組森林義勇救火隊。

Passing railways, nearby factories, and electric wires in or near forest protection areas must have specified safety equipment.

森林所有人必須在森林發生生物為害或有發生之虞時，進行撲滅或預防。

當森林生物危害有擴散或可能擴散時，主管機關可以命有利害關係的森林所有人採取必要的撲滅或預防措施；相關費用原則上由森林所有人負擔，但費用負擔人另有約定者依約定。

中央主管機關負責訂定森林保護管理、災害防救、保林設施、防火宣導及獎勵辦法；國有林位於原住民族傳統領域土地時，相關造林、護林執行的輔導經營管理辦法，由中央主管機關會同中央原住民族主管機關訂定。

地方主管機關要普查轄區內樹木，將認定為受保護樹木者造冊公告；公告後還要加強保護、定期健檢養護並公布現況。中央主管機關負責訂定普查方法和認定標準。

開發範圍內如有公告的受保護樹木，原則上要原地保留；未經地方主管機關許可，不得砍伐、移植、修剪或破壞。

開發利用者在受保護樹木移植申請受理後，須先舉行公開說明會；地方主管機關之後須再舉行公聽會，並公告日期地點、追蹤管理已許可移植的樹木及定期更新現況。

經地方主管機關許可移植受保護樹木時，地方主管機關可命開發利用者提供土地或資金，作為補植的生態補償。

達中央主管機關指定規模以上的樹木保護與管理，應由依法登記執業的林業、園藝及相關專業技師，或聘有這些技師的技術顧問機關來規劃、設計及監造。

森林所有人申請登記時，應檢附所在地名稱、面積、竹木種類與數量、地圖及計畫，向主管機關申請。

For this Act, a person who has superficies, a lease, or another use or profit right over someone else’s land for the purpose of owning bamboo or wood is treated as a forest owner.

If a forest is neglected, overdeveloped, or overcut, the local competent authority may direct the owner on how to manage it. If that direction is violated, or if bamboo or timber is overcut, the authority may order cutting to stop and require reforestation.

If a person ordered to carry out afforestation under the previous article does not do it, the competent authority may carry it out itself, and the person must pay the afforestation costs.

If public or private barren hills or barren land are incorporated into forestry land, the competent authority may set a deadline and order the owner to afforest the land.

Within forest areas, waste must not be piled up or pollutants discharged without authorization.

林產物採取人要設帳簿記錄林產物種類、數量、來源和銷路，並要選定記號或印章向當地主管機關備案，且在林產物搬出前使用；也不得使用他人已申報的相同或相似記號或印章。

伐採林產物後，要先經主管機關許可並查驗，才能運銷。

與林業用地及林產物有關的稅賦，依法可減除或免除。

符合條件的經營林業者，可以獲得獎勵；獎勵方式包括獎勵金、匾額、獎牌及獎狀。

對於保護或認養樹木且有特殊成績的人，可以準用前條第二項的獎勵。

主管機關應為私人、原住民族或團體造林提供免費種苗、獎勵金、長期低利貸款或其他輔導獎勵；相關辦法由中央主管機關會同中央原住民族主管機關訂定。

政府應設置造林基金，用於獎勵私人或團體長期造林；基金來源包括水權費提撥、山坡地開發利用者繳交的回饋金、罰鍰、工程費提撥、預算撥款、捐贈及其他收入。

國有荒山、荒地編為林業用地時，除保留供國有林經營外，中央主管機關得劃定區域，出租給本國人造林。

林業之管理經營應以國土保安的長遠利益為主要目標。

偷取森林主、副產物，或收受、搬運、寄藏、故買、媒介贓物的，會處刑責與罰金；未遂也罰，特定貴重木情形還會加重處罰。

A person who unlawfully cultivates or occupies another person's forest or land is punishable by imprisonment and may also be fined. Harsher penalties apply if disaster, death, or serious injury results, and attempted and negligent offences are also punishable.

If someone commits the Article 50 offense and one of the listed aggravating circumstances applies, this article imposes imprisonment and a fine, and it also covers attempts, forfeiture, and a possible reduced or exempted punishment for certain cooperating suspects or defendants.

Setting fire to, or negligently causing, a forest fire that burns another person’s forest is punishable by imprisonment and, in some cases, a fine. Attempted commission of the first offence is also punishable.

毁弃或损坏保安林，且足以对公众或他人造成损害的，可能构成犯罪，并可处三年以下有期徒刑、拘役或新台币三十万元以下罚金。

未經允許在他人森林或林地內墾殖或占用的人，對他人因此受到的損害負賠償責任。

If a person violates the listed provisions, they are fined between NT$120,000 and NT$600,000.

If any listed violation occurs, a fine of NT$60,000 to NT$300,000 may be imposed.

在森林遊樂區或自然保護區內，未經主管機關許可，不得從事列舉行為，違者可處新臺幣5萬元以上20萬元以下罰鍰。

Certain acts in forest recreation areas and nature reserves are punishable by an administrative fine of NT$1,000 to NT$60,000; indigenous conduct needed for living customs is exempt.

主管機關可處罰本法所定的罰鍰；如果罰鍰在限期內仍未繳納，會移送法院強制執行。

中央主管機關負責訂定本法施行細則。

本法自公布日開始施行。

符合條件的荒山、荒地可由中央主管機關商請中央地政主管機關編為林業用地並公告；已編為林業用地的土地原則上不得作其他用途。

公有林或私有林符合列舉情形之一時，中央主管機關可以將其收歸國有，並且應給予補償金。

國有或公有林地在符合特定必要用途時，可以出租、讓與或撥用；如果違反指定用途，或在指定期間內未依指定用途使用，該林地應收回。

在森林內進行特定工程、採礦或採取土石前，須先報請主管機關會同相關機關實地勘查同意，並依指定施工界限施工。
