動物傳染病防治條例

This provision states that the statute is enacted to prevent animal infectious diseases from 발생, transmission, and spread, and that matters not covered by the statute are governed by other laws.

When animal disease prevention or quarantine personnel implement prevention measures, relevant agency personnel must assist and cooperate.

在依本法進行防疫或檢疫時，檢舉應予獎勵；獎勵辦法由中央主管機關訂定。

任何人不得故意散播與動物傳染病有關的謠言或不實訊息。

Animal owners or managers must report certain animal deaths to the animal disease authority; carriers must report deaths during transport; the authority must inspect and order disposal steps; and small household-side poultry deaths may be self-handled in limited cases.

中央主管機關 must establish a management system for holders or users of relevant infectious biological materials, and those holders or users must accept guidance and inspection and not evade, obstruct, or refuse it.

就中央主管機關指定公告的動物傳染病，檢體檢驗、結果報告與確定，依本條規定辦理。

主管機關為防治動物傳染病，可以命動物防疫人員或委託執業獸醫師實施檢查、注射、投藥等措施，並可要求動物所有人或管理人配合；當事人不得故意破壞相關標記或文件，也不得規避、拒絕或妨礙執行。

中央主管機關得就特定動物傳染病的防治，規定疫苗使用、標示、申報、移動管制等事項；相關人員與業者應依規定辦理。

Local authorities may designate areas and require animal owners/managers to carry out disease-prevention measures; animal transport operators must clean and disinfect vehicles and crates/cages.

中央主管機關可以禁止在公告零售市場展示、陳列或販售受特定重大人畜共通動物傳染病影響的活禽。

化製場和化製原料運輸車在處理化製原料時，必須符合消毒、管理、契約、紀錄保存、查核與通報等要求。

獸醫師或獸醫佐在執行業務時發現特定動物傳染病，須在24小時內向當地動物防疫機關報告。

動物防疫機關在動物傳染病發生後如有迅速蔓延之虞，應立即向上級主管機關報告，並通知鄰近及與動物集散相關的直轄市或縣（市）政府。

動物所有人或管理人對疑患動物傳染病的動物，必須依動物防疫人員指導迅速隔離並採取必要措施；動物防疫人員也可禁止動物移出或移入，並可命令隔離繫養最長14日，必要時可延長。

本條定義主管機關與動物防疫機關，並要求主管機關在事項涉及國民健康時會同衛生主管機關處理。

地方主管機關在防疫有緊急處置必要時，可以命轄區內動物防疫人員先依前條處理，之後再報請核備。

地方主管機關為防治動物傳染病蔓延，得命相關人員進行檢查、注射、疫苗投與、藥浴或投藥；動物所有人或管理人應依指示配合，控制動物行動並提供必要協助，且不得規避、妨礙或拒絕。

動物因第六條第一項甲類或乙類動物傳染病死亡後，其所有人或管理人應依動物防疫人員指示，迅速進行焚燬、掩埋、化製或其他必要處置；如為病因鑑定或學術研究且經主管機關認可，則依主管機關指示辦理。

在一定期間內，掩埋地點及標識未經主管機關許可，不可擅自開掘或燬損。

When an animal carried on a ship dies from, or is suspected of having, an infectious animal disease, the owner, manager, or captain of the carcass, place, or equipment may disinfect it or take other necessary measures.

動物所有人或管理人要在宰殺疑似或確診動物傳染病的動物前，先向動物防疫人員報告；防疫人員可就撲殺方法與場所等作出指示。

地方主管機關在懷疑動物有傳染病，且為防疫上需要鑑定病因時，可以命動物防疫人員對該動物或屍體進行剖驗。

If competent authorities consider epidemic prevention necessary, they may announce quarantine measures; local authorities must report implementation and notify nearby authorities, and the central authority sets inspection rules.

When needed for disease prevention, the local competent authority may order certain animal-related venues to stop operating and may ban animal competitions, horse races, and other animal-gathering activities.

This provision defines “防治” for this条例 to include prevention, disease prevention, and quarantine matters.

中央主管機關在認為必要時，可以派所屬動物防疫人員主持跨縣市或縣市與直轄市間的動物傳染病聯合防疫，或協助直轄市、縣（市）主管機關辦理相關防疫事宜。

When the animal infectious disease has been eradicated, the local city/county authority must announce the lifting of restrictions, report it to the central authority for record, and notify nearby local authorities.

Certain quarantinable animals or goods must be brought in, transited, or transshipped only at published ports or stations, and quarantine must be carried out at designated places.

動物檢疫機關在部分檢疫物不合格時，原則上應認定整批不合格；但若評估沒有動物傳染病傳播或交叉污染風險，也可以逐件認定。檢疫結果要通知輸入人、輸出人或其代理人；檢疫不合格者不得申請複檢。

中央主管機關 must announce foreign animal disease outbreak status and apply quarantine measures for designated quarantine goods; importers or agents may need pre-import approval, inspection, or case-specific quarantine conditions.

進口應施檢疫物的人、代理人、攜帶入境的旅客或機上人員，通常都要在到達或入境時向動物檢疫機關申請檢疫並繳驗文件；郵寄進口被禁止，未檢疫完成前也不得擅自處理檢疫物。

輸出入應受隔離檢疫的動物前，須先向檢疫機關請准安排隔離場所；輸入後也要依指示在指定期間送交隔離檢疫。隔離期間，未經許可不得進出隔離場所，也不得未經檢查許可移動動物、檢疫物或藥品。

輸入應施檢疫物有特定違規情形時，輸出入動物檢疫機關得視情節採取必要處置。

應施檢疫物在過境或轉口前，所有人、代理人或管理人應先向輸出入動物檢疫機關申請檢疫；若不是為輸入目的而進儲自由貿易港區，申請程序或文件可簡化。

動物檢疫人員可在必要時先行檢疫，並可對有感染風險的檢疫物及運輸工具採取必要處置。

符合指定情形的輸出檢疫物，輸出人或其代理人要先向輸出入動物檢疫機關申請檢疫，並在檢疫合格、核發輸出動物檢疫證明書後才能輸出。

If the listed matters or sampling matters occur during quarantine, the export-import animal quarantine authority handles them.

來自國外的車、船或航空器上所載廚餘，不得離開該車、船或航空器；若已離開，必須依輸出入動物檢疫機關核准的方式運送並銷燬。

輸入人、所有人、管理人或其代理人，須負擔本條所列必要處置的費用。

在特定涉及境外應施檢疫物的網路內容經公告後，相關廣告刊登者、平台、應用服務提供者或電信事業須依公告採取防疫警語、資料保存/提供，以及限制或移除內容等措施。

中央主管機關可以訂定關於應施檢疫物的檢疫申請、動物檢疫證明書核發、密閉式貨櫃運送、以及旅客或車、船、航空器服務人員攜帶等事項的辦法。

This provision defines which animals count as “animals” under the statute.

主管機關要成立評價委員會、評定價格，並依規定發給補償費；但特定違規情形及輸出入檢疫、隔離留檢死亡的動物不發補償。

Unauthorized import of quarantinable goods prohibited under Article 33(1)(1) is punishable by up to 7 years’ imprisonment and a fine of up to TWD 3 million.

符合條件的運輸工具，應予沒入；明知有前項情事而取得所有權者，亦同。

This provision sets fines and possible criminal penalties for certain animal-quarantine related violations, and allows orders to correct the violation and repeated penalties if not corrected.

違反本條列出的多種動物防疫相關規定，可能被處新臺幣5萬元以上100萬元以下罰鍰，並可被限期改善；逾期未改善者，還可能按次處罰。

If any of the listed violations occurs, a fine of NT$20,000 to NT$100,000 may be imposed, improvement may be ordered by a deadline, and repeated penalties may follow if the violation is not corrected in time.

This provision sets fines for many animal disease control and quarantine violations, and allows the authority to order correction and repeat penalties if the violation is not fixed on time.

旅客或服務於車、船、航空器的人員，如果沒有依第三十四條第二項申請檢疫，會被處以罰鍰。

本條規定，本條例所定的罰鍰，由直轄市、縣（市）主管機關或輸出入動物檢疫機關處罰。

中央主管機關有權訂定本條例的施行細則。

This provision says the statute takes effect on the date it is published.

This provision defines “quarantine items” and gives the central competent authority power to designate and announce certain item types as items subject to quarantine.

The central authority must classify and announce animal infectious diseases into three categories based on severity. Local city/county authorities may order other animal infectious diseases to be covered by part or all of the Act to prevent spread.
