勞動者原則上應依僱方或其代理人指示提供勞務;但若指示違法、不道德,或對健康過於有害,則不適用。 勞動者原則上沒有提供約定勞動以外的附帶勞動義務;但在緊急情形或職業上有特別習慣時,不得拒絕其能提供的勞動。 勞動者在勞動時間外,沒有勞動義務;但法律或團體協約另有特別規定時,不適用。 勞動者在從事工作時要注意妥善行事;如果材料由雇方提供,還要注意使用材料、報告消費數量,並把剩餘材料返還。 A labor contract may include a post-employment non-compete clause, but only when the worker learned the employer’s technical secrets through the employment relationship and the clause must be in writing and limited in type of business, geography, and time.
