公共服務擴大就業暫行條例

This provision states that the law is enacted to quickly ease unemployment by creating public-service job opportunities for unemployed people and by helping small and medium-sized enterprises with manpower.

進用人員在進用期間原則上不適用勞動基準法與就業保險法；用人機關（團體）與進用人員應依中央主管機關準則，以書面訂定定期契約。

用人機關（團體）在進用期間，應依法為其進用人員辦理勞工保險及全民健康保險；若不符合勞保規定，則改投保其他平安保險或意外險。

用人機關（團體）在遴選和進用失業者時，要符合公平公開原則，並考量各縣市失業人口比例，優先進用失業家庭成員；每戶以進用一人為限。

This provision says the expenses needed for the statute are handled through an additional budget process, and the spending is capped at NT$20 billion.

本條限制經費用途：依本條例進用人員的人事費用及相關稅捐，不得少於各該工作計畫經費的85%，且各機關行政人員不得支領前項經費。

本條例的施行日期由行政院以命令決定，施行期間為一年。

本條文指定本條例的主管機關為行政院勞工委員會；屬中央各目的事業主管機關職掌的事項，由該等機關辦理。

This provision lists the kinds of public service work covered and says the Executive Yuan sets the rules for small and medium-sized enterprise manpower assistance.

行政院為推動公共服務工作，負責相關計畫、審定、經費籌措運用及監督管考，並可視業務需要分設工作小組。

主管機關或中央各目的事業主管機關可以為執行本條例的工作，委任、委託或委辦所屬機關、其他機關或地方政府辦理。

第三條所列工作的執行期間最長為六個月；符合「有繼續執行之必要且績效良好」者，得展延。

People hired to do public service work must be referred by a public employment service agency, and referred persons must meet the listed qualifications unless an exception applies.

依本條例進用的人員，在進用期間不得領取就業保險法所定的各項給付、津貼或其他促進就業相關津貼。

依本條例進用的人員，其累計進用期間不得超過十二個月。
