空氣污染防制法

This provision states the law is enacted to prevent air pollution, protect the living environment and public health, and improve quality of life.

總量管制區的總量管制計畫，必須載明指定事項；符合空氣品質標準與未符合空氣品質標準的地區，所需內容不同。

This provision says the law takes effect on the day it is promulgated.

直轄市、縣（巿）主管機關應依前條總量管制計畫，訂定並修正空氣污染防制計畫；在未符合空氣品質標準的總量管制區，還要指定固定污染源、減量及期程。

在建立污染源排放量查核系統和排放交易制度後，中央主管機關要先會商經濟部，再報請行政院分期分區核定公告實施總量管制規定。

中央主管機關和各級主管機關要設置空氣品質監測站，並定期公布空氣品質狀況與原始資料；相關設置與監測準則由中央主管機關訂定。

When air quality is at serious risk of worsening, competent authorities and public/private places must immediately take emergency measures, and authorities must issue an air-quality warning. Authorities may also restrict vehicle use, emissions, and certain agency/school activities.

特殊性工業區開發者 must 在區界周邊規劃緩衝地帶，並在適當地點設置空氣品質監測設施；中央主管機關可訂定相關類別、記錄、申報與設置標準，並應定期公布申報狀況及原始資料。

主管機關得就排放空氣污染物的固定污染源與移動污染源徵收空氣污染防制費。

中央主管機關收取空氣污染防制費，並按來源將一定比例撥交給地方主管機關；費率由中央主管機關會商後訂定，符合條件時地方主管機關可提出調整建議。

空氣污染防制費原則上只能用於空氣污染防制相關事項；主管機關可以設基金管理並設管理會監督，且須公開實際支用情形。

Certain fixed pollution sources may apply to the local authority for incentives, and fee-payers under Article 16(1) may apply for reduction or exemption of air pollution control fees.

This article defines which government body counts as the competent authority under the Act, depending on whether the matter is at the central, special-municipality, or county/city level.

公私場所固定污染源排放空氣污染物時，必須符合排放標準。

具有經中央主管機關指定公告之固定污染源的公私場所，必須按季在每年1月、4月、7月及10月底前，向直轄市、縣（市）主管機關申報前一季空氣污染物排放量。

Certain fixed pollution sources must install automatic monitoring equipment, continuously monitor operations or air pollutant emissions, and report/seek approval from the local environmental authority. Some sources designated for connection must also connect their equipment to the local authority and make it public online.

Public and private places must collect air pollutants and keep pollution control or monitoring facilities operating normally; a fixed pollution source must not exceed the control facility’s maximum treatment capacity.

具中央主管機關公告之固定污染源，在設置或變更前要先申請並取得設置許可證；設置或變更後還要申請操作許可證，並依許可證內容操作。

公私場所在遷移或變更產業類別時，應重新申請設置及操作許可證；已取得操作許可證而因總量管制或排放標準修正致內容不符者，也應在公告期限內重申請。

空氣污染防制計畫及相關證明文件，原則上要由依法登記執業的環境工程技師或其他相關專業技師簽證。

符合條件的同一公私場所，可向地方主管機關申請調整多個固定污染源的空氣污染物總量與濃度；核准後，個別污染源可不受第二十條的排放標準限制。

Using certain fuels or auxiliary fuels for public/private fixed pollution sources requires compliance with the prescribed blending/composition standards, a use permit, recordkeeping, and reporting to the local competent authority.

Using substances likely to cause air pollution requires prior permit approval, recordkeeping, and reporting to the local competent authority.

This provision defines key terms used in the air pollution law.

許可證原則上有效5年；期滿要繼續使用的，應在到期前3至6個月申請展延。

中央主管機關可以禁止或限制特定易致空氣污染物質及其相關產品的製造、進口、出口、販賣或使用，並可公告清單及訂定許可與審查等辦法。

在各級防制區或總量管制區內，不得從事會造成空氣污染的列舉行為；中央主管機關並可訂定執行管制準則。

發生固定污染源突發事故並大量排放空氣污染物時，負責人要立即採取緊急應變措施，並在一小時內通報地方主管機關。

Certain public and private premises designated by the central competent authority must establish air pollution control dedicated units or personnel, and designated premises emitting hazardous air pollutants must establish dedicated health risk assessment personnel.

公私場所原則上要把指定許可證、申報資料、證號資料和應變計畫公開到中央主管機關指定網站；國防機密或核准的工商機密可例外不公開。

移動污染源排放空氣污染物應符合排放標準；使用中的汽車要逐車檢驗並符合該標準。汽車製造者或進口商不得安裝會影響排放的減效裝置，但有兩種例外。

移動污染源的使用人或所有人必須維持空氣污染防制設備正常運作，且不得拆除或改裝未經中央主管機關認證的設備。

汽車在特定場所、地點或氣候條件下怠速停車時，怠速時間必須符合中央主管機關的規定。

製造、進口、販賣或使用供移動污染源用的燃料，原則上要符合中央主管機關定的燃料種類與成分標準；專供出口者除外。

各級主管機關可以指定或委託專責機關（構）處理空氣污染訓練及防制相關事宜。

主管機關得依空氣品質需求和污染特性劃設空氣品質維護區，並實施移動污染源管制措施。

If used cars fail emissions standards because of design or equipment defects, the manufacturer or importer must recall and fix the sold vehicles by the deadline set; if they still do not comply, manufacturing, importing, and selling must stop.

汽車在申請牌照前，必須先取得中央主管機關核發的車型排氣審驗合格證明，並完成中央主管機關驗證核章。

中央主管機關可以委託其他機關辦理汽車排氣定期檢驗，並可支付委託費用；該費用也可以由汽車排氣檢驗費扣抵。

Cars must undergo regular exhaust emissions testing. Vehicles that fail the emissions standard must be repaired and re-tested within one month of the inspection date.

主管機關可在特定場所對使用中的移動污染源進行不定期檢驗或檢查，也可通知疑似有污染的交通工具在指定期限內到指定地點受檢。

排放不合標準的使用中汽車，通知後要在期限內修復並到指定地點接受檢驗；人民也可以向主管機關檢舉排放情形。

製造、進口或販賣經主管機關公告含揮發性有機物的化學製品，應符合其成分標準；專供出口者不受此限制。

主管機關可以派員檢查、鑑定並要求提供資料；公私場所不得規避、妨礙或拒絕，且應設置方便檢查的設施。

檢驗測定機構必須先取得中央主管機關核給的許可證，才能辦理本法規定的檢驗測定。

中央主管機關要依土地用途、空氣品質需求或狀況，劃定並公告各級防制區；空氣品質標準由中央主管機關會商相關機關訂定，且至少每四年檢討一次。

各目的事業主管機關應輔導各種污染源改善，且相關輔導成果須每年公開於中央主管機關指定的网站，並定期檢討。

違反第33條第1項的緊急應變義務，或不遵行主管機關依第33條第2項所下命令，若因此造成死亡、重傷或危害健康致病，會有不同刑責與罰金。

A person who violates the import or export restriction rules in the measures under Article 31(2) can be imprisoned for 6 months to 5 years and may also be fined NTD 300,000 to NTD 1,500,000.

公私場所固定污染源的排放管道若排放空氣污染物，違反第二十條第二項標準的有害空氣污染物排放限值，且足以損害他人生命或身體健康者，會受到刑事處罰。

有申請或申報義務的人，如果明知內容不實而申請、申報不實，或在業務文書中作虛偽記載，會受到刑罰與罰金處罰。

在沒有空氣污染防制設備，或設備未運作時，燃燒易生特殊有害健康之物質，會受到刑罰。這類物質由中央主管機關公告。

違反主管機關依本法發出的停工、停業、停止操作或停止作為命令者，會面臨徒刑、拘役或罰金。

如果法人代表、代理人、受僱人或其他從業人員因執行業務而犯本條列明的罪，除處罰行為人外，該法人或自然人也可能被科以最高十倍以下的罰金。

特殊性工業區開發者如違反指定設施或標準規定，會被罰鍰並要求限期改善；未改善的，還會按次處罰。

公私場所如有本條列舉的違規情形，會被罰鍰；情節重大時，還可能被命停工、停業，甚至廢止操作許可或勒令歇業。

In a level 1 control zone, new or changed fixed pollution sources are generally prohibited, except for facilities needed for residents’ daily needs, national park management, or national defense. Level 2 and level 3 zones allow some new or changed sources only if emissions meet specified modeling and control-technique requirements.

If a public or private place violates Article 6(1), it faces a fine of TWD 20,000 to TWD 1,000,000. If the violator is an industrial factory or site, the fine is TWD 100,000 to TWD 20,000,000 and operations are ordered to stop.

公私場所違反列出的污染減量或差額管理規定時，會被處罰鍰；若違反者是工商廠、場，罰鍰金額更高，且可被限期補正或改善，逾期仍未完成時可按次處罰，情節重大時還可能被停工、停業，甚至廢止操作許可或勒令歇業。

公私場所違反列舉的空氣污染相關規定時，會被裁罰；工商廠、場適用較高罰鍰，且可能被要求限期補正，逾期仍未改善會按次處罰，情節重大時還可能停工、停業，甚至被廢止操作許可或勒令歇業。

未依第二十四條第1項或第2項取得許可證，就逕行設置、變更或操作的，可處罰鍰；若違反者是工商廠、場，罰鍰較高，並可命停工及限期補辦許可。

Public or private places that violate certain permit-condition, recordkeeping, reporting, or management rules may be fined, with higher fines for industrial factories or sites.

違反第十四條相關管理規定者，會被處以罰鍰；情節重大時，還可能被命令停工或停業。

Users or owners who violate the listed provisions can be fined and ordered to fix the problem; if they still do not comply, further penalties may be imposed. Manufacturers or importers who violate Article 36(5) face a larger per-vehicle fine and revocation of their vehicle type emissions inspection approval certificate.

Violations of any item in Article 32(1) are punishable by a fine, with a higher fine range for industrial factories or sites.

If a person violates the rules on permits, records, reporting, or management for manufacturing, selling, or use, they can be fined, told to fix or report by a deadline, and may face repeated penalties or suspension/closure in serious cases.

公私場所違反指定規定時，會被處新臺幣20萬元至200萬元罰鍰，並被通知限期補正或改善；逾期未補正或完成改善的，得按次處罰。

中央主管機關要訂空氣污染防制方案，並每四年檢討修正；直轄市、縣（市）主管機關要依規定擬訂空氣污染防制計畫、報中央主管機關核定後公告，並每四年檢討修正，且在擬訂時要考量污染流通性質並與鄰近地方主管機關協商。

符合列舉情形者，會被處新臺幣20萬元以上100萬元以下罰鍰，並可能被要求限期補正或改善。

Certain public/private premises and users or owners of mobile pollution sources may be fined for evading, obstructing, or refusing inspections, examinations, or orders, or for lacking required facilities.

違反第47條第1項的人，會被處新臺幣10萬元以上、100萬元以下罰鍰；主管機關還會通知限期改善，逾期未改善者，得按次處罰。

Manufacturers, sellers, or importers may be fined NT$100,000 to NT$1,000,000 for certain violations, and users may be fined NT$5,000 to NT$100,000 for violating Article 39(1).

逾期未繳費用會按日加徵滯納金；逾期30日仍未申報或繳納的，還會被罰鍰，工商廠、場的罰鍰更高，並須限期繳納。

如果公私場所以偽造、變造或其他不正當方式短報、漏報空氣污染防制費計算資料，主管機關可以按二倍計算應繳費額；若因此逃漏費用，還可追溯五年並按日加計利息。

違反怠速停車限制或主管機關公告的移動污染源管制措施，會被罰鍰；主管機關也可以命其改善，未改善者可按次處罰到改善為止。

製造者或進口商若不遵行中央主管機關限期召回改正的命令，將按每輛汽車處新臺幣十萬元罰鍰；違反召回改正管理規定者，處新臺幣五千元以上二十萬元以下罰鍰，並可能被通知限期補正或改善，逾期未完成者可按次處罰。

If either listed compliance violation occurs, a fine of NT$5,000 to NT$200,000 is imposed, and the authority will order correction or improvement by a deadline; if the deadline passes without completion, repeated fines may be imposed.

移動污染源使用人或所有人如果未依規定檢驗，或檢驗不符合排放標準，會被處罰鍰，並通知限期改善；逾期未改善的，還會按次處罰。

中央主管機關可以指定總量管制區並公告實施；區內固定污染源依空氣品質是否達標，需遵守不同的排放控制、認可、削減與抵換規則。

未依規定做排放空氣污染物定期檢驗、逾期未修復複驗，或違反檢驗站設置管理規定，都可能被裁罰；情節嚴重時還可能被限期改善、按次處罰、停業或廢止認可。

If the required improvement documents are not submitted before the deadline, the situation is treated as incomplete improvement. The central competent authority sets the rules for deadlines, verification methods, enforcement, and related management matters.

本條規定補正、改善或申報的期限最長為90日；遇天災或其他不可抗力時，當事人可在原因消滅後繼續改善並在15日內向主管機關申請核定期限；公私場所也可在接獲通知後30日內提出改善計畫申請延長。

本法的處罰由中央的行政院環境保護署處理；在直轄市、縣（市）則由當地政府處理。

汽車所有人或使用人拒不繳納罰鍰時，直轄市、縣（市）主管機關可以請公路監理機關配合停止辦理車輛異動。

罰鍰金額要依污染源、污染物、程度、特性及危害程度來裁處；若違規情節影響學校，應加重處罰。

違反本法義務而有利益者，除罰鍰外，還可在利益範圍內被追繳；相關追繳由各級主管機關以行政處分作成。

特種基金的來源，除空氣污染防制費外，還應包括指定交易或拍賣所得、追繳所得利益、罰鍰的一部分、罰金，以及沒收或追徵後的現金或變賣所得。

符合條件的公私場所，應在公告日起二年內申請操作許可證。

If a fixed pollution source’s related equipment malfunctions and causes a violation, the site must respond immediately and follow the listed reporting, repair/stop, and written-report deadlines to qualify for exemption from punishment.

指定的固定污染源抵換污染物增量或排放量時，必須從列出的來源取得，且以較低比例抵換；若拍賣由各級主管機關辦理，拍賣辦法由中央主管機關訂定。

公私場所事前逐案申請並經核可後，從事列舉行為可免依本法處罰；主管機關在特定空氣條件不利或未依核可內容實施時，得命暫緩或停止。

各級主管機關辦理檢驗、核發許可證或證明、以及受理申請的審查或許可時，應收取相關規費；收費標準由中央主管機關會商有關機關訂定。

空氣污染物受害人可以向各級主管機關申請查明受害原因；主管機關查明後可命排放者立即改善，受害人也可以請求適當賠償。

受害人民或公益團體可先書面通知主管機關；若通知送達後60日內仍未依法執行，可直接向行政法院起诉，请求法院命其执行。

People or groups may report violations or vehicle air-pollution emissions to the local competent authority, and the authority must keep the reporter’s identity confidential.

公私場所不得因員工揭露違法、作證或拒絕參與違法行為而解僱、降調、減薪或為其他不利處分；違法處分無效，且相關機關須提供法律扶助。

This provision defines when conduct counts as “serious circumstances” and requires authorities to publish affected places, stop and recover preferential benefits for the violation year, and bar further government preferential treatment for three years.

受停工或停用污染源處分的公私場所，恢復操作或復工前要先申請試車；試車期滿前還要提出符合排放標準的證明，經主管機關評鑑合格後，才能恢復。

公私場所要把試車計畫登載到中央主管機關指定的公開網站供民眾查詢；直轄市、縣（市）主管機關在核准前要讓利害關係人和公益團體表示意見，若以會議審查，還要在會後製作會議紀錄並公開登載。
