飲用水管理條例

This provision states the law was enacted to protect drinking water source quality, improve public drinking water quality, and safeguard national health, and that matters not covered by it follow other relevant laws.

Certain drinking water equipment designated by the central competent authority must comply with national standards; if no national standard exists, the central competent authority may announce a standard.

飲用水水質應符合飲用水水質標準；該標準由中央主管機關訂定。

設置供公眾飲用連續供水固定設備的人，應依規定採樣、檢驗水質，並作成紀錄、揭示及備查；相關檢測事項的辦法由中央主管機關定之。

檢驗測定機構必須先取得中央主管機關核發的許可證，才能辦理本法所規定的檢驗測定。

Drinking water treatment chemicals may only be used if they have been announced by the central competent authority.

各級主管機關要定期選點採樣檢驗、整理分析，並依檢驗結果採取適當措施；如證明有危害人體健康之虞，應立即公告禁止飲用。

在天災或其他不可抗力導致飲用水水源水質惡化時，相關供水單位要立刻採取應變措施、加強水質檢驗，並迅速通知民眾水質狀況與因應措施。

主管機關可出示證件進入公私場所，檢查飲用水相關事項並採樣、索取資料；場所所有人、使用人或管理人不得規避、妨礙或拒絕。

被禁止作為飲用水水源或供飲用的取水或供水單位，原因消失後，須由具許可的外部環境檢驗測定機構採樣與送檢，並報經處分機關核准後，才能恢復供飲用或作為水源。

違反特定條文且經通知禁止後仍不遵行者，可能受一年以下有期徒刑、拘役，並得併科罰金；若因此致人於死或重傷，刑度與罰金加重。

If someone violates Article 13, they may be punished with up to one year’s imprisonment, detention, or a fine of up to NT$60,000, or both.

If certain business-related offences are committed by a company’s representative, agent, employee, or other staff, the actor is punished under the relevant article and the company or individual is also fined.

This provision defines the competent authority for this regulation at different government levels.

違反第5條第1項的人，會被處新臺幣10萬元以上、100萬元以下罰鍰，並被通知禁止該行為。

違反第六條第一項者，會被處以新臺幣6萬元以上60萬元以下罰鍰，並會被通知禁止作為飲用水水源。

違反第八條的人，會被處新臺幣一萬元以上十萬元以下罰鍰，並被通知限期補正；逾期未補正者，得按次處罰。

設置供公眾飲用的連續供水固定設備者，如有列舉違規情形，會被處新臺幣一萬元以上十萬元以下罰鍰，並被通知限期改善；逾期未改善，還會按次處罰。

違反飲用水水質第十一條第一項的人，會被罰鍰，並被通知限期改善；逾期未改善的，還會按日連續處罰，情節重大者不得供飲用。

違反第十二條之一第二項所定辦法者，會被處罰鍰，並可能被要求限期改善；逾期未改善的，還可能按日連續處罰，情節重大時可被命停業，必要時還可廢止許可證。

公私場所在限期改善、申報或補正期限屆滿前，應檢具符合飲用水水質標準或其他規定的證明文件，向主管機關報請查驗；否則視為未完成改善。

中央主管機關可訂定按日連續處罰的起算日、暫停日、停止日、改善完成認定查驗及其他應遵行事項。

Anyone who evades, obstructs, or refuses an inspection under Article 15, or who provides false samples or data, may be fined.

受限期改善通知者，如因天災或其他不可抗力而無法如期完成，須在原因消滅後繼續改善，並在十日內書面說明理由、檢附證明，向原核定機關申請重新核定改善期限。

This provision assigns who administers penalties under the Act: the central environmental protection authority, municipal governments, or county/city governments, unless the Act provides otherwise.

This provision is deleted.

Packaged or containerized drinking water for sale must comply with the water-source quality management rules in this provision, and its containers, packaging, manufacturing hygiene, labeling, advertising, and water-quality inspection must follow the Food Sanitation Management Act.

依第八條公告、且在公告前已設置連續供水固定設備的公私場所，應在公告日起六個月內申請登記。

Equipment management related to tap water must follow the Water Supply Act.

公告的公私場所，如設有供公眾飲用的連續供水固定設備，使用前要向直轄市、縣（市）主管機關申請登記。

設置供公眾飲用之連續供水固定設備者，應依規定維護設備，製作並揭示維護紀錄，且保存供主管機關查驗；相關方法、頻率、紀錄方式、揭示與保存期限由中央主管機關定辦法。
