環境基本法

This provision states the law’s purpose: to improve environmental quality, promote public health and welfare, protect environmental resources, and advance sustainable development. Where this law does not provide a rule, other laws apply.

各級政府必須由專責機關或單位規劃、推動和輔導環境保護事務，並應充足編列環境保護經費，且依實際需要合理分配。

各級政府可以聘請環保相關機關、團體代表及學者專家提供諮詢，也可以邀請民眾與團體共同參與推動環保工作。

中央政府應推動與地球永續發展有關的國際合作、技術協助、工程技術及試驗研究，並公開相關資訊；地方政府可視需要辦理。

中央政府 must provide environmental protection training and set up a qualification system for environmental protection professionals; enterprises must set up an environmental protection unit or personnel and make an environmental protection plan under the relevant rules.

法院可以為審理環境保護糾紛案件，設立專庭或指定專人辦理。

各級政府應蒐集、調查、評估轄區內的環境狀況，建立環境資訊系統，並提供查詢；相關環境資訊也應定期公開。

各級政府在土地開發利用時，應以高品質、寧適、和諧的環境為目標，並優先考慮環境保護設施。

各級政府可以劃定區域並採取必要措施或限制人為活動及使用；並應依土地使用及限制程度予以補償及回饋。

各級政府應積極保育野生生物，並保護森林、潟湖、濕地等環境，同時加強水資源保育、水土保持與植被綠化。

各級政府必須採取措施保護非再生性資源，並對已超限或接近極限利用的稀有資源定期調查評估，必要時採取改善或限制措施。

This provision defines “environment” and “sustainable development.”

各級政府應積極採取措施，保護海洋環境、強化海岸管理，並防制地下水超限利用、地層下陷及海岸侵蝕。

各級政府應積極採取二氧化碳排放抑制措施，並訂定相關計畫。

各級政府應積極研究並建立環境與健康風險評估制度，並採取預防與醫療保健措施，以降低健康風險、預防和減輕與環境有關的疾病。

政府應訂定計畫，逐步達成非核家園目標，並加強核能安全、輻射防護、放射性物料管理與環境輻射偵測。

中央政府必須建立環境影響評估制度。

中央政府要依社會需要和科技水準訂定階段性環境品質及管制標準；地方政府可以在轄區內訂更嚴的標準並經中央政府備查；各級政府都要採取必要措施達成這些標準。

中央政府應就環境污染行為，以及稀有資源與自然文化資產的利用，建立事前許可、查核、申報、管制和稽查制度。

各級政府必須建立環境監測網，定期公布監測結果，建立預警制度，並採取必要措施。

中央政府應建立污染者付費制度，並向污染及破壞者徵收污染防治及環境復育費用。

行政院應設置國家永續發展委員會，由其負責相關業務決策，並由相關部會執行。

Economic, technology, and social development should take environmental protection into account, and environmental protection comes first if development would seriously harm the environment or pose a risk of harm.

中央政府應設置一個負責環境資源的專責部會。

中央政府應依法設置各種環境基金，並負責環境清理、復育、追查污染源及推動有益於環境發展的事項。

各級政府要加強環境保護公共建設、提升環境品質，並向受益者或使用者收取適度費用；事業要加強興建相關環境保護處理設施。

中央政府必須建立環境糾紛處理制度，並建立與環境相關的緊急應變、損害賠償、補償及救濟制度。

When governments fail to act, people or public-interest groups may sue the competent authority in administrative court. The court may also order the defendant agency to pay certain litigation-related fees to a plaintiff who has made a concrete contribution to environmental quality.

中央政府應獎勵環境保護學術及研究機構，支持設備充實、人員延攬培訓、引進先進科技、整合研究資源，並加速相關示範計畫與研究發展。

各級政府應採優惠獎勵、輔導與鼓勵措施，支持環境保護事業、民間環保團體發展，並鼓勵民間投資；中央政府還應輔導並管理環境保護事業。

各級政府應就環境保護相關事項，採取適當的優惠、獎勵、輔導或補償措施。

各級政府應採取必要措施，促進再生資源及其他有助於減少環境負荷之材料、產品與勞務的利用；其採購原則上應使用再生資源製品及環保標章產品。

各級政府必須執行環境保護相關法規；對於違反者，應依法取締並處罰。

國民、事業及各級政府都要共同負擔環境保護的義務與責任；污染者或破壞者要就其造成的環境危害或風險負責。

June 5 is designated as Environment Day to promote environmental protection awareness and concern for environmental issues.

This law takes effect on the date it is promulgated.

國民應以環境保護為原則，減少日常生活造成的環境負荷，並進行廢棄物減量、分類與回收。

Businesses must build environmental protection into planning and operations, use a life-cycle approach, and help government carry out environmental protection measures.

中央政府 must make environmental protection rules, set a national environmental protection plan, create sustainability indicators, and promote implementation. Local governments may make local rules and plans when needed in their area. All levels of government must periodically review and publish implementation status, and the central government must assist local governments.

各級政府施政要優先納入環境保護與永續發展，並發展相關科學技術及建立環境管理和綠色消費的經濟效率系統。

各級政府應推廣環境保護優先與永續發展相關教育及宣導，促進國民環境知識與環保觀念落實於日常生活。
