通訊傳播基本法

本法說明其制定目的：因應科技匯流，促進通訊傳播健全發展，維護國民權利，保障消費者利益，提升多元文化，並平衡城鄉差距。

The allocation and management of scarce communications resources should follow principles of fairness, efficiency, convenience, harmony, and technology neutrality.

政府應採取必要措施，促進通訊傳播基礎網路互連。

政府應配合通訊傳播委員會的規畫，採取必要措施，促進通訊傳播的接近使用與服務普及。

通訊傳播委員會每年要提出績效報告和改進建議；若建議涉及修法，還要說明修法方向和理由。

在天然災害、緊急事故或其發生風險下，政府為公共利益可要求通訊傳播事業採取必要的應變措施。

The government must actively promote and participate in international cooperation to support communications development, and may delegate the work to private groups when necessary and allowed by law.

政府應在通訊傳播委員會成立後兩年內，依本法原則修正通訊傳播相關法規；在修正施行前，通訊傳播委員會可就與本法牴觸或競合的情形，依本法原則解釋與適用法律。

本法自公布日開始施行。

政府應設通訊傳播委員會，並由其依法獨立行使職權；行政院所屬機關負責辦理國家通訊傳播整體資源規劃及產業輔導、獎勵。

政府應設置通訊傳播監督管理基金。

通訊傳播應維護人性尊嚴、尊重弱勢權益，並促進多元文化均衡發展。

政府應鼓勵通訊傳播新技術及服務的發展，沒有正當理由不得限制。

Government should not manage differently just because different transmission technologies are used, except for rare-resource allocation.

The setting of communications and broadcasting technical standards, and related testing and verification work, should be guided by the principle of promoting interoperability.

通訊傳播事業應公開消費所需的必要資訊，並提供公平合理的服務，以保障消費者權益。
