廣播電視事業發展基金條例

This provision establishes the Broadcasting and Television Industry Development Fund and says it is referred to as “the Fund.”

本基金應設監事三人，其中一人為常務監事；監事人選由主管機關遴聘。

本基金董事、董事長、監事、常務監事為無給職；開會時可酌支車馬費。

The board may hire staff as needed for business purposes, and its organizational structure must be approved by the board and then submitted to the competent authority for approval.

本基金章程由董事會訂定。

本基金的會計年度要與政府會計年度一致；預算在年度開始前編訂並經董事會通過後報主管機關，決算在年度終了後編具並經監事會審核後報主管機關。

廣播電視事業如果違反第4條和第7條，隱匿或短報盈餘，規避、未為或未調整提撥，經主管機關通知後仍未按期補正提撥的，可能在申請換發執照時被拒絕換發。

熱心捐助本基金的人可以獲得獎勵；具體辦法由主管機關訂定。

本條例的施行日期由行政院以命令決定。

This provision says the fund’s sources are government and social donations, and surplus from broadcasting and television businesses.

本基金的主管機關是行政院新聞局。

廣播電視事業 must 按盈餘分級累加提撥，廣播事業與電視事業適用不同級距與百分比。

The fund’s income from interest must be allocated back to the fund.

This provision lists what the fund may be used for: producing good public radio and public television programs, training broadcasting and television personnel, rewarding outstanding broadcasting and television workers, and subsidizing necessary equipment to improve broadcasting and television industry standards.

廣播電視事業機構應在年度終了後三個月內編造決算表並報主管機關備查；如有盈餘，還要按第四條標準提撥繳入專戶。

The fund has a board, and the board is responsible for safeguarding, reviewing, and using the fund.

本基金董事會應設董事九人至十五人，其中一人為董事長；董事人選由主管機關遴聘。
