衛星廣播電視法

This provision says the law is enacted to promote healthy satellite broadcast television development, protect the public’s viewing interests, support media diversity, expand Taiwan’s international media space, and strengthen regional cultural exchange.

主管機關在法定拒絕事由成立時，應附理由駁回衛星廣播電視事業申請；主管機關也可訂定董事、監察人等負責人資格與其他管理辦法。

This provision sets license terms: certain satellite broadcasting businesses and their foreign satellite broadcasting branch companies have licenses valid for 6 years, and foreign satellite broadcasting agents follow the agency contract term but cannot exceed 6 years.

衛星廣播電視事業及其境外事業的分公司或代理商，不得委託他人經營，也不得把執照出租、出借、轉讓或設定擔保給他人。

設置地球電臺時，相關衛星廣播電視事業、境外衛星廣播電視事業分公司或代理商應向主管機關申請許可。

持有相關衛星廣播電視事業執照者，應依營運計畫日期開播；如無法如期開播，須附理由向主管機關申請展期。

許可後如申請書或營運計畫內容變更，相關衛星廣播電視事業分公司或代理商原則上要向主管機關申請變更；某些情形可例外。

執照內容變更時，相關事業或其分公司、代理商應在15日內向主管機關申請換發；執照遺失時，應在15日內申請補發。若變更內容屬設立登記事項，須先經主管機關許可變更後，才能辦理設立或變更登記。

主管機關應在執照屆滿三年時，對衛星廣播電視事業及境外衛星廣播電視事業的分公司或代理商所提營運計畫執行報告辦理評鑑。

衛星廣播電視事業及其境外分公司或代理商，須在執照到期前六個月向主管機關提出換照申請並附營運計畫。

主管機關在審查後，如果認為申請人有營運不善之虞，或要求限期補正資料而屆期未補正、補正不全，可以駁回申請。

This provision defines several terms used in the law on satellite broadcasting, programs, advertisements, sponsorship, and product placement.

主管機關應召開諮詢會議審議特定申設、評鑑、換照事項，並在會後30日內把委員名單和會議紀錄提供給申請人。

衛星廣播電視事業或境外衛星廣播電視事業若要暫停或終止全部或部分頻道經營，須先於三個月前書面報請主管機關備查，並於一個月前通知訂戶。

Certain satellite channel program providers must set up a self-regulation mechanism, handle viewer complaints about accuracy, balance, and taste, and report to the competent authority with the information made public.

直播衛星廣播電視服務事業及其境外分公司播出的購物頻道數，必須低於全部頻道數的百分之十。

相關業者在沒有正當理由時，不得對特定電視、節目供應或播送平臺業者給予差別待遇。

遇有天然災害或緊急事故時，主管機關可以指定衛星廣播電視事業播送特定節目或訊息；原因消滅後，主管機關應通知其恢復原狀繼續播送。

衛星廣播電視事業及其境外分公司或代理商，對節目、廣告與新聞評論內容須尊重多元文化、維護人性尊嚴，並遵守事實查證與公平原則；若涉及特定違規新聞情形，還要先依自律機制調查並提報主管機關。

衛星廣播電視事業及其境外分公司或代理商，必須把播送的電視節目分級；主管機關也可以限制以兒童為主要收視對象的頻道或節目廣告內容與播出時間。

主管機關可以指定某些節目或廣告在特定時段播出，或採鎖碼方式播送；相關衛星廣播電視業者及其境外業者的分公司或代理商，應將鎖碼方式報請主管機關核定。

本法的主管機關是國家通訊傳播委員會。

相關衛星廣播電視事業及其境外分公司或代理商播送的節目，應能清楚辨認，並與插播的廣告分開；但法律另有規定的除外。

衛星廣播電視事業及境外衛星廣播電視事業之分公司或代理商，對特定節目與廣告不得播送，並在置入性行銷時須揭露相關訊息。

接受贊助時，衛星廣播電視事業及其境外分公司或代理商要在節目播出前後揭露贊助者訊息；在不影響收視者權益下，也可以在運動賽事或藝文活動節目畫面中顯示贊助者訊息。

用於置入性行銷及揭露贊助者的時間，不計入廣告時間；相關節目類型、辨認區隔、揭露方式與限制等辦法由主管機關訂定。

衛星廣播電視事業原則上不得使用插播式字幕；只有在列出的幾種情況下才可使用。

衛星廣播電視事業播送依法須先經主管機關核准的廣告時，必須先取得核准證明文件後才能播送。

衛星廣播電視事業及其境外分公司或代理商的廣告時間，不得超過每一節目總時間的六分之一；單則廣告超過三分鐘或以節目型態播送時，畫面上要標示「廣告」；轉播運動賽事或藝文活動時，應在適當時間插播廣告，不得任意中斷節目。

衛星廣播電視事業及境外衛星廣播電視事業之分公司或代理商設立購物頻道時，不受第三十四條及前條第一項、第二項限制。主管機關並可訂定購物頻道插播式字幕的使用基準、方式及其他應遵行事項。

直播衛星廣播電視服務事業及其境外分公司，不得播送未經第六條或第六十四條準用第六條第一項許可的相關節目或廣告。

主管機關在認為有必要時，可以於節目或廣告播送後二十日內，向相關衛星廣播電視業者、分公司或代理商索取該節目、廣告及其他資料。

衛星廣播電視事業的組織形式限於股份有限公司或財團法人；其最低實收資本額與捐助財產總額由主管機關決定；外國人直接持有其股份須低於已發行股份總數的百分之五十。

如果衛星廣播電視節目評論涉及他人或機關、團體並損害其權益，被評論者在對方要求相當答辯機會時，不得拒絕。

衛星廣播電視事業可以把本國自製節目播送到國外，且在這樣做時應遵守國際衛星廣播電視公約及慣例。

Certain satellite TV service operators must sign written contracts with subscribers; some channel-supply sellers may use written or electronic contracts, and the electronic contract must show key purchase information and be filed for review.

相關業者要依主管機關指定項目，每年申報營運情形；申訴案件要即時處理並保存三個月，主管機關也可要求以書面或節目中回覆。

利害關係人若認為衛星廣播電視節目或廣告有錯誤，可在播送日起20日內要求更正；事業收到要求後，應在10日內於同一時間的節目或廣告中更正，若認為無誤，則要用書面附理由回覆請求人。

衛星廣播電視內容如果侵害姓名、名譽、隱私、信用、肖像或其他人格權益，被害人可以向法院請求刪除該部分、必要修正，或在有侵害之虞時請求防止；業者如故意或過失不法侵害他人權利，應依民法負賠償責任。

Certain satellite broadcast-related businesses may be fined NT$300,000 to NT$3,000,000 and ordered to stop operating if they violate specified rules or keep operating after a permit is revoked or withdrawn.

他類頻道節目供應事業違反第六十四條第三項或第四項時，會被罰鍰新臺幣30萬元至300萬元，並被命令停止經營。

Certain satellite broadcasting businesses and related entities can be fined if they violate listed broadcasting rules; repeat noncompliance after a stop-broadcast order can lead to broadcast suspension or license cancellation.

相關衛星廣播電視及頻道節目供應事業違反指定規定時，主管機關可罰鍰，並命限期改正；逾期不改正的，還可按次處罰，或廢止許可並註銷執照。

This article bans certain government, party, and public-official-related actors from investing in, founding, or managing satellite broadcasting television businesses, and sets correction deadlines for existing noncompliance.

Certain satellite broadcasting businesses and related suppliers may be warned or fined NT$60,000 to NT$300,000, and they must be ordered to correct the violation within a deadline.

This provision gives transitional rules for operators of other channel program supply businesses, including a permit application deadline and limits on continued operation.

If an application or business plan for a satellite broadcasting business branch or agent is incomplete but can be corrected, the competent authority must notify the applicant to fix it by a deadline.
