公務人員任用法

Public servant appointments are handled under this Act.

各機關初任人員原則上要依考試錄取順序先分配訓練，訓練及格後再任用；沒有正額錄取人員可分配時，經同意可自行遴用合格人員。

辦理機要職務的人員可以不受第九條任用資格限制；機關長官可隨時將其免職，且機關長官離職時，該等人員也應同時離職。

各機關在進用機要人員時，應注意公平、正當，以及條件和職務之適當性；相關員額、職務範圍與任用條件規範由考試院定之。

This provision sets appointment qualifications for people who pass different civil service examinations, with different exam grades linked to different appointment grades.

本條規定，特定在法施行前已依法考試及格或依法銓敘合格實授的人，取得與擬任職務相近、程度相當的任用資格；其考試類科適用職系由銓敘部會同考選部定之。

考試院有權訂定職系、職組及職系說明書。

通過升官等考試的人，可取得相應職等的任用資格。

Certain qualified exam-passers may count prior good-service years for promotion/grade purposes when transferring between comparable posts, except where transfer is barred by law.

公務人員晉升官等，原則上須通過考試或訓練；部分職等的升任還要符合年資、考績、學歷與其他資格，且某些情況可先調派但要在期限內補訓合格。

現職公務人員調任有範圍限制，部分職等可在特定職系間調任，某些人員不得調到較低官等或特定職務，但有自願與特殊核准例外。

For positions graded at two or three levels, a new appointee must be appointed at the lowest listed grade, subject to stated exceptions and caps.

Civil servant appointment should prioritize specialist talent, professionalism, and fitting the right person to the right role.

Certain newly appointed civil servants must serve a six-month probation if they lack the required experience, and agencies must assign someone to guide them.

Except where the law provides otherwise, agencies must not assign people who do not meet Article 9 qualifications to act in proxy roles or hold positions that require those qualifications.

各機關原則上不得任用其他機關人員；如有業務需要，可以指名商調，但對考試及格人員仍受相關限制。符合條件的受限轉調人員，為親自養育三歲以下子女者，得在限制轉調期間內調任至子女實際居住地的其他機關，且通常限一次。

符合條件的現職人員要予以改任；相關改任辦法由考試院訂定。

各機關先派代理公務人員後，應在實際代理日起3個月內送銓敘部審定；特殊情形可報准延長最多2個月；審定不合格的，應立即停止代理。

人事人員要催辦並協助試用及擬任人員依期送銓敘部審定；逾期未送審可停止代理，若因人事疏誤，機關要查明責任並懲處。

各機關在公務人員經銓敘部審定合格後，應呈請總統任命。

各機關長官不得任用自己的配偶或三親等內血親、姻親到本機關，或任用為直接隸屬機關之長官；對本機關各級主管長官的配偶及三親等內血親、姻親，也應在其主管單位中迴避任用。

各機關首長在列明期間內，不得任用或遷調人員。

各機關不得進用已屆限齡退休人員。

Certain people may not be appointed as civil servants, and existing civil servants must be dismissed, retired, severed, or have their appointment revoked if listed disqualifying facts apply.

公務人員因育嬰、侍親、進修等事由，經機關核准後，得留職停薪；原因消失後，應回職復薪。

This provision defines nine employment-classification terms used by the law.

If an agency’s personnel appointments violate this law, the Ministry of Civil Service must notify the agency to correct it and copy the audit authority; the pay may not be reimbursed, and serious cases can be reported for demotion/removal and further handling.

對依法適用本法的機關，如其組織法規與本法牴觸，應適用本法。

This provision says the appointment of judges, auditors, accounting officials, customs officials, diplomatic and consular officials, and police officers is to be separately set by law, and rules on appointment qualifications must not conflict with this Act.

教育人員、醫事人員、交通事業人員及公營事業人員的任用，另由法律規定。

本條規定：原依已廢止的技術人員任用條例審定的人員，原則上依本條所列規則改任、續任、調任與晉升。

This provision says that the transfer of certain professional and technical personnel who have passed specified examinations into civil service positions will be separately regulated by law.

After the Mongolian-Tibetan Personnel Appointment Regulation is repealed, certain current employees may keep being appointed under that former rule until retirement or leaving office, but only for transfer to central government agencies.

各機關以契約定期聘用專業或技術人員的，該聘用方式另由法律規定。

本條規定派用條例廢止後，相關現職派用人員如何改任、續派、留任與退休資遣，以及臨時機關的組織法規應如何調整。

考試院制定雇員管理規則；修正施行後，各機關不得新進雇員，但期限屆滿時仍在職的雇員可以繼續僱用到離職為止。

This provision says the Act does not apply to political appointees, except for Articles 26, 26-1, and 28.

本法的施行細則由考試院定之。

各機關任用公務人員時，應先注意品德、忠誠及職務適任性，並在任用前辦理查核；必要時可請相關機關協助，涉及國安或重大利益者可辦理特殊查核。

This provision sets rules for classifying agency jobs, preparing staffing tables, and the roles of the Examination Yuan and related agencies.

各機關應為法定職務設定工作項目、工作量與工作權責，並訂定職務說明書；職務內容變動時要及時修訂，且應定期辦理職務普查。

各機關組織法規所定的職務，應依職系說明書歸入適當職系，並列表送銓敘部核備。

公務人員任用原則上須具備法定資格；特殊性質職務還要符合特別遴用規定。初任職務者要具備擬任職務所列職等的任用資格，未具資格者可在同官等高二職等範圍內權理，且權理人員可隨時調任相當性質相近職務。
