專門職業及技術人員轉任公務人員條例

本條例是依公務人員任用法第三十四條制定。

符合條件的各機關現職人員，可以在修正條文施行後二年內，依原規定辦理原職改派。

Certain current technical personnel who were approved for appointment as technical staff and passed specified exams may be reassigned/appointed under the prior rules and Civil Service Employment Act Article 23 within two years.

各機關為應業務需要，得設置公職律師、公職建築師及各類公職專技人員職務。

If this provision does not cover a matter, the Appointment Act, the Civil Servants Promotion Act, and other related laws apply.

本條規定，本條例的施行細則由考試院訂定。

本條例的施行日期由考試院定；第八條及第九條除外，直接自公布日施行。

People who pass the specified higher or ordinary special examinations, or equivalent special examinations, may be transferred into civil service under this Act; if another law says otherwise, that law applies instead. People who passed a qualification review are not included in the term “examination passers.”

This provision defines “professional and technical personnel” as people who have passed the listed examinations and meet the relevant professional practice qualification requirements.

專技人員轉任公務人員時，只能轉任與其考試等級相同、類科與職系相近的職務；機關並須依考試與錄取情形核算名額，辦理初任訓練，且轉任人員在任職初期受主管職與跨機關調任限制。

用人機關在進用專技人員時， պետք 先組成遴選委員會辦理公開遴選；委員會成員要包含機關代表與外部學者專家，且學者專家不得少於一半，並須自人才庫遴聘。

符合特定考試及格且具相關年資與實績證明的專技人員，可以依年資轉任不同官等職務，並按規定職等任用。

轉任人員原則上從前條規定任用職等的最低俸級起敘；若先以委任第五職等任用，則敘委任第五職等本俸五級。

轉任人員調任時，原則上只能在特定職系間調任；符合一定年資與考績條件者，另有例外可調任行政類或技術類職系職務，且技術類轉任人員還有一項再調任限制。

符合條件的轉任人員，可取得升任簡任第十職等的任用資格。
