公務人員退休法

Civil servants’ retirement is handled under this Act.

This provision sets which retirement pension a retiring person may receive based on years of service and, in one case, age.

本條規定特定退休人員何時可以領月退休金、可以選擇哪些退休金方式，以及部分人員可加發退休金；若退休後一年內再任特定公職，需按比例收回加發部分。

符合本條條件的退休人員，依任職年資與年齡可選擇一次退休金或月退休金等給付方式；部分修法前已符合條件者可不受月退休金起支年齡限制。

因公傷病命令退休者在特定情形下，任職年資不足時按較長年資計算，並可加發一次退休金；加發標準由考試院定，費用由各級政府編列預算支給。

退休金領受人死亡時，遺族可依順序領取一次撫慰金；符合條件的配偶、子女和父母也可選擇月撫慰金。

符合條件的月退休金領受人及其遺族，按舊制標準支給，且特定遺族可改領月撫慰金。

This provision defines the people covered by the Act and says retirement or layoff handling is limited to current personnel unless the Act says otherwise.

自願、屆齡退休人員要先備齊證明文件，經服務機關在退休生效日前送銓敘部核定；通常以生效日前三個月送達為原則。命令退休人員也要備齊文件，由服務機關轉送銓敘部核定。

公務人員在列舉情形之一時，會喪失申請辦理退休或資遣的權利。

月退休金或月撫慰金在特定情形下會停止領受；溢領的退休金由支給機關依法追繳。

領月退休金或兼領月退休金的人，如果出現列舉情形之一，就喪失領受月退休金的權利。

公務人員若在職期間犯貪污或瀆職罪，且退休、資遣或離職後才判刑確定，依法會被剝奪或減少退離給與，已領取的部分也可能被追繳。

Certain survivors may not apply for condolence money, and some survivors lose the right to receive monthly condolence money, if the stated disqualifying conditions apply.

請領退休金、撫慰金、資遣給與的權利，不得拿來扣押、轉讓或作為擔保。

退休金、資遣給與、離職退費、撫慰金等請求權，原則上自可行使日起五年內不行使就消滅；特定離職退費人員在符合條件時，得在年滿65歲後一年內申請，且不受前述時效限制。

法官不適用本法的屆齡退休和命令退休規定；符合本法退休條件的法官，也可以自願退休。

公務人員在新舊退撫制度下的任職年資要合併計算，但舊制最多採計30年、新制最多採計35年；超過35年時，由當事人自行取捨。

公務人員退休分為自願退休、屆齡退休及命令退休。

符合特定年資條件的公務人員，退休金要依規定選擇同一給付方式；部分情形可另領補償金，並按年資增減。

銓敘部受理退休、資遣或撫慰金案件後，原則上應在2個月內核定或審定；必要時可以延長1個月。

退休申請人和公務人員必須在申請時審慎決定相關退休給與選項；申請生效日一經核定，或經銓敘部核定並領取給與後，就不能再請求變更。

辦理退休或資遣且在中華民國100年4月1日前生效者，其退撫新制實施前累計未滿1年的年資零數，依修正施行前的原規定計算。

本法的施行細則由考試院訂定。

This provision says the Act takes effect on the date it is promulgated, and the 13 July 1990 amendment takes effect on 1 January 2001.

公務人員符合本條列出的年資、年齡或職等條件時，應准其自願退休；在機關裁撤、組織變更或業務緊縮並依法令精簡時，未符前項條件者也有例外可准退休。

公務人員任職滿五年以上、年滿65歲時，應屆齡退休；危險或勞力等特殊職務的退休年齡可在主管機關規定並經銓敘部認定後下調，但不得低於55歲。

符合年資、身心障礙與工作勝任條件的公務人員，機關應命令退休；符合情形但未提出醫療證明者，可先令病假治療，逾請假期限仍不能勝任或未痊癒時，機關應主動辦理命令退休。

符合條件的精簡退休或資遣人員，原則上可一次加發最高七個月的俸給總額慰助金；但若在退休或資遣生效後七個月內再任特定職務，須由再任機關扣回並繳回餘額。
