政務人員退職酬勞金給與條例

政務人員的退職酬勞金給與，依本條例辦理。

月退職酬勞金自退職後的次月開始發給。

People in any of the listed situations lose the right to receive retirement remuneration.

If either listed condition applies, the person’s right to receive monthly retirement pay is suspended until the cause ends.

已領退職酬勞金的人員，若再任政務人員或其他公職人員，無須繳回已領的退職酬勞金；其退職前服務年資在重行退休或退職時也不併計。

符合條件的遺族可領一次撫慰金；符合特定親屬條件者，若不領一次撫慰金，還可以改領月撫慰金。

政務人員退職後死亡、且尚未失去退職酬勞金請領權利時，遺族可領一次撫慰金；符合條件的遺族也可選擇改領月撫慰金。

請領退職酬勞金的權利，不得被扣押、讓與或供擔保。

This provision combines service years before and after the amendment for certain public officials, sets caps and benefit rules, and allows some survivors to elect a monthly survivor pension instead of a lump sum.

考試院會同行政院有權訂定本條例的施行細則。

This provision says the statute starts on publication, the amended provisions start on 1 May 1996, it expires 18 months after the amended text is published, and its operating period may be extended by one year with Legislative Yuan consent.

本條例適用於列舉的高層公職人員，以及副總統、臺灣省省長和直轄市市長。

政務人員退職酬勞金的給與，由考試院會同行政院辦理。

政務人員服務滿2年以上退職時，可依年資領取退職酬勞金；服務15年以上者可在一次金、月退職酬勞金或兩者各半中擇一，但未滿50歲且有工作能力者不得選月退職酬勞金或其半額組合。

Certain political personnel retired due to injury or illness in the course of duty are exempt from the two-year service-year limit.

政務人員退職時，若曾任軍、公、教人員，且其服務年資未曾依規定核給退休（伍）金或資遣給與，該年資得合併計算。

原服務機關要將政務人員服務年資及退職酬勞金的計算，轉請考試院會同行政院核定。

政府與政務人員共同撥繳基金支付退職酬勞金；政府另負最後支付保證責任。

請領退職酬勞金的權利，從退職後的次月起算，5年不行使就會消滅。
