公職人員年資併社團專職人員年資計發退離給與處理條例

This provision states that the Act is enacted to address overpaid retirement and severance benefits after combining public servant and association full-time staff seniority.

This article defines the terms “public official,” “association staff,” and “retirement benefits” for this statute.

本條規定本條例的法制主管機關是銓敘部，執行主管機關是前條所定公職人員適用之各該退休（職、伍）法令的中央或地方主管機關。

核發退離給與機關要先扣除已採計的社團專職人員年資，再重新核計退離給與；若重算後每月總額低於新臺幣2萬5千元，原則上補到2萬5千元，但原本就低於2萬5千元的，仍按原額發給。

如有溢領退離給與，核發機關應在本條例施行後一年內以書面命返還，並按適用的追繳規定辦理追繳。

If a retired public servant’s benefits are recalculated under Article 4, the survivor consolation payment must be calculated using that recalculated benefit standard.

本條就第四條重行核計退離給與及第五條返還規定，排除現行法律關於權利行使期間的適用，但本條例另有規定者除外。

法制主管機關必須就本條例所定業務執行狀況向立法院報告，並立即在網站公布。

This provision says the regulation takes effect on the date it is promulgated.
