公務人員撫卹法

公務人員的撫卹事項，依本法辦理。

公務人員遺族在特定情形下不得請領撫卹金，且在領受年撫卹金期間若發生特定事由，會喪失年撫卹金領受權。

If a civil servant’s survivor has lost civil rights without restoration, or has an unresolved wanted case, the survivor’s right to receive survivor pension benefits is suspended until the cause ends.

請領撫卹金的權利，自可行使日起算，五年不行使就會當然消滅。

The right to claim a pension and an unclaimed pension by survivors cannot be seized, assigned, or used as security.

When a civil servant dies, all levels of government must budget funeral subsidy payments, and the subsidy standard is set jointly by the Examination Yuan and the Executive Yuan.

同一順序且有多名撫卹金領受權遺族時，申請撫卹金應共同提出；也可委任一名有行為能力者代辦。

公務人員遺族如不服撫卹案審定結果，可以依公務人員保障法提起救濟；如有顯然錯誤，或有新事實、新證據等行政程序再開事由，可以依行政程序法辦理。

遺族年撫卹金自公務人員死亡次月起給與，給與年限依死亡情形不同；無子女的寡妻或鰥夫可終身領卹，子女未成年或仍在學者可在一定條件下續領。
