公務人員陞遷法

Civil servants’ promotions are handled under this Act, unless another law provides otherwise.

Certain listed government posts may be approved directly without review/selection, and their holders may also be exempt when reassigned, except where a promotion case under Article 4 requires review/selection.

符合條件的機關人員，經甄審委員會同意後，可以優先陞任；同時符合多人時，第一款所列第五種情形者優先，並且同一事實只能使用一次。

各機關人員在列明情形之一時，不得辦理陞任；同樣規定也適用於外補陞任。

各機關應依職務性質和業務需要，辦理所屬人員的各類遷調；這些遷調可免經甄審（選），而遷調規定由各主管機關訂定。

公務人員升任較高官等職務時，應依法接受陞官等訓練；各主管機關應對初任各官等主管職務者實施管理才能發展訓練。

公務人員若認為機關辦理的陞遷違法並損害其權益，可以依公務人員保障法提起救濟。

辦理陞遷業務的人員不得徇私舞弊、遺漏舛誤或洩漏秘密；遇到涉及本人、配偶或三親等內血親、姻親的甄審（選）案件，應迴避。

教育人員、交通事業人員及公營事業人員的陞遷，可以準用本法規定。

Certain personnel promotion rules may be separately set by the competent authority, and the resulting rules must be sent to the Examination Yuan for record.

各機關在依相關條文訂定並發布標準、遷調規定或準用規定時，應將其函送銓敘部備查。

Civil service promotions and transfers should fit the person and the job, follow merit principles, and be handled openly, fairly, and impartially.

本法的施行細則由考試院訂定。

本法自公布日起施行。

This provision says the Act applies to staff in government agencies and public schools who have specified positions and are appointed or assigned under law, except political appointees and confidential personnel.

This provision defines when a civil servant transfer or promotion counts as “promotion.”

機關職缺原則上要依資格、甄審或公開甄選辦理，並在特定情況下可免經甄審（選）。

各機關應依職務高低及業務需要訂定陞遷序列表，並在機關內職缺由本機關人員陞遷時，依序逐級辦理；在特定情況下可按職等等順序處理，沒有適當人選時可改由下一序列人選陞任。

各機關辦理本機關人員陞任、遷調或外補時，須依一定項目訂定標準並評分，必要時可面試或測驗；外補時另須訂定資格條件、甄選及評比方式。

Most agencies must set up a promotion review committee to handle civil servant promotion screening and selection, with a few specified exceptions.

各機關辦理公務人員陞遷時，人事單位要依資格或積分造列名冊並送甄審；機關首長如對結果有不同意見並改採其他甄選方式時，須附理由。
