中華民國八十一年度中央政府總預算執行條例

This provision says the条例 is made to implement the central government’s 81st-year budget, and matters not covered by it are governed by other relevant laws.

總預算內的公教人員實物經費、婚喪生育及子女教育補助費、以及眷屬生活補助費等，可依向例由行政院核定支撥。

本條要求年度預算內的外匯收支，應依實際執行時的匯率核實辦理；總預算內各機關若因匯率較預算標準低而節省經費，該部分應列為決算中的經費賸餘，不得流用。

附屬單位預算機關要按業務情況編造分期實施計畫和收支估計表；若預算執行期間因市況變動或業務擴增而需增加管理費用，得依已通過預算的法定方式併入計算，並按預算法第56條程序辦理。

各主管機關要依總預算案所列事項辦理；行政院主計處、財政部及審計機關要分別監督其主管事項，並在次會期向立法院報告辦理情形。

本條例自公布日起執行，並以中華民國八十一會計年度的起訖日期作為有效期間。

Agencies with budgeted revenue must collect it according to law, send off-budget income and budget over-collections to the treasury, include them in final accounts, and not offset or use them as temporary advances.

If the amounts differ after legislative review, the Executive Yuan must adjust the budgeted amounts to the Legislative Yuan’s final approved amounts and carry them out.

各主管機關應按預算數額，及時報解應繳庫的盈餘與事業收入；實收數額超過法定預算列數時，也要依第二條規定辦理。

各機關的預算如果已被立法院刪除，不得另外動支第二預備金；但經立法院同意的，不受此限制。

When saleable national property has a market price above the budgeted amount, it must be sold at market price.

各機關要依法編送歲出分配預算，核定後切實執行；經常性支出原則上按月分配，資本性支出可配合計畫進度核實分配。

If a government agency’s actual budget execution differs by more than 20%, the agency head may be disciplined unless there are unavoidable special factors, and the agency must report the execution status to the Legislative Yuan.

機關辦理營繕工程合約時，應載明材料與工資價款；在符合漲幅門檻時，材料或工資超過部分可以調整，但逾期完工或交貨者不適用。
