統計法

This law is enacted to improve government statistics and protect their objectivity, independence, and quality.

中央主計機關必須至少每10年辦理一次人口及住宅普查，並至少每5年辦理一次農林漁牧業普查及工業、服務業普查的基本國勢調查。

中央主計機關辦理基本國勢調查時，應先擬具調查方案並報請行政院核定；也可以請各級政府成立臨時調查組織協助，並可要求相關機關協助、借調人員及指揮監督。

各機關辦理指定或一般統計調查，必須限於與業務直接相關且確有迫切需要的情形；若資料可由其他法定資料取得，或可併入類似調查，就不得再辦理。

機關在舉辦達一定規模的指定或一般統計調查前，應先擬具實施計畫並依程序送核或備查；核定後還要在調查表註明核定文號。

統計調查人員執行職務時，應出示證明文件並告知受查者查證方式及機會；不得冒用職務名義取得未經授權蒐集的資料。進行基本國勢調查或指定統計調查時，任何人不得規避、妨礙或拒絕。

統計調查的受查者都要在期限內據實回答。

各機關發布統計資料，限於主管業務範圍內；並應預告統計資料項目的發布訊息，除有重大情事外不得任意變更。

機關建立或修改行政資料處理系統時，通常要先徵詢相關主計機構需求；中央機關若涉及地方政府業務，還要另行徵詢地方主計機關及有關機關；主計機關也可因整體統計需要要求增修系統資料項目或功能。

統計主計機關為統計需要或減輕受查者負擔，可以向政府及所屬機關要求第四條第二項第一款、第二款資料；各機關應配合。

各機關必須妥善保管統計相關文件及資料，並提供給本機關執行公務使用；屬統計調查取得的個別資料，還必須保密，只能用於統計目的。

政府辦理統計業務，原則上依本法規定；但各機關辦理專為意向性調查或學術研究的統計，不適用本條。

Government accounting bodies handling statistical work are subject to supervision and guidance by the relevant higher-level accounting authority.

If the principal statistic officer and the agency head disagree on statistical business, the matter is handled by the superior authority’s head and the principal statistic officer.

Government accounting/statistics agencies may audit and recheck statistical 업무 of subordinate agencies, and the central accounting agency may audit and recheck local governments’ statistical 업무.

If someone violates Article 14(3) by evading, obstructing, or refusing a basic national conditions survey or a statistical survey by designated survey personnel, and counseling fails, the matter is handled under the Administrative Execution Act.

Survey respondents must answer basic national situation or designated statistical surveys correctly and on time after counseling, or the matter will be handled under the Administrative Execution Act.

辦理統計業務的各機關人員，如違反第十四條第二項或第十九條，依相關法律處理。

本法的施行細則由中央主計機關訂定。

政府及各機關應辦理指定的統計工作。

政府統計原則上由直接相關機關辦理；例外情形下，基本國勢調查由中央主計機關主辦，不屬任何機關的政府統計由各級政府主計機關協調辦理，中央政府也可以委辦地方政府辦理統計調查。

各機關在編製公務統計時，應充分利用第四條第二項第一款的資料。

各機關的公務統計作業，應由負責統計業務的主計機構人員與相關業務人員共同辦理。

各機關應在第六條所定方案的統計範圍內，依其公務性質與業務需要，訂定公務統計方案。
