About this statute

The Act's short title is the Nile Basin Initiative Act, 2002. Section 2 provides definitions for terms used in the Act, including “Agreed Minute No. 7”, “Minister”, “Nile Basin Initiative” (NBI), “Nile Basin States” and “Nile River Basin”. The NBI must, within Uganda, have the capacity of a body corporate (perpetual succession) with powers over property and to sue/be sued; it also must have capacity to perform functions under the Agreed Minute No. 7 and to take necessary actions including borrowing; subsection (2) does not authorise disregarding any law. Payments required under Agreed Minute No. 7 must be charged on and paid out of the Consolidated Fund; the Minister responsible for finance may raise loans or make arrangements (subject to article 159 of the Constitution) to provide sums for such payments; moneys received under the Agreed Minute No. 7 must be paid into and form part of the Consolidated Fund. The NBI, its staff and officials are entitled to privileges and immunities within Uganda necessary for their functions.
