Section 15-21-25 Remand or Commitment to Custody or Restraint for Public Offense When Commitment Irregular.
In habeas corpus proceedings, a person may be sent back to the original custody or restraint if that custody is legally entitled to continue; otherwise, the person must be committed to the proper officer or person.
