Section 9-11-264 Liability for Injury or Damage to Persons or Domestic Animals of Persons Using Traps, Etc., to Take, Capture, Etc., Fur-Bearing Animals; Exemption of Lawrence County.

A person who uses a trap or similar device on public land to take, capture, or kill protected fur-bearing animals is strictly liable for resulting injury or damage to a person or domestic animal. An injured person may bring a civil damages action and does not have to prove negligence. Lawrence County is exempt.
