Section 16-22-1.1 Police Officers at State Colleges and Universities or Institute for Deaf and Blind -- Employment of Reserve Police Officers.

(a) The president or chief executive officer of any public institution of higher education in the state that employs police officers pursuant to Section 16-22-1, Section 16-22-2, or another law, may employ one or more reserve police officers, with or without compensation, to assist or aid those full-time or part-time police officers. Reserve police officers employed pursuant to this section shall serve at the pleasure of the president or chief executive officer of the employing institution. (b) Any individual desiring employment as a reserve police officer shall submit a written application to the president or chief executive officer of the institution certifying that he or she is 19 years of age or older, of good moral character and reputation, and that he or she has never been convicted of a felony or of a misdemeanor involving force, violence, or moral turpitude. The applicant shall also consent in writing to a fingerprint and criminal history background check. (c) The functions of a reserve police officer employed pursuant to this section shall be confined to the following: (1) Patrol operation performed for the purpose of detection, prevention, and suppression of crime or enforcement of the traffic or highway laws of the state, provided the reserve police officer shall only perform these duties under the direct control and supervision of a police officer employed by the same institution. (2) Traffic direction and control, without direct supervision, provided supervisory control is exercised by a police officer employed by the same institution whose total span of control would be considered within reasonable limits. (3) Crowd control assistance at public gatherings or campus functions as directed by the president or chief executive officer of the institution, provided supervisory control is exercised by a police officer employed by the same institution whose span of control would be considered within reasonable limits. (d) No reserve police officer may exercise any power of arrest unless he or she has completed and maintains current certification from the Alabama Peace Officers’ Standards and Training Commission as set out in Article 3, Chapter 21, Title 36. (e) No reserve police officer may carry any firearm while on duty, unless the president or chief executive officer of the employing institution has approved his or her use of the firearm. Reserve police officers may use approved firearms only to the extent permitted by properly adopted policies of the institution.
