Section 12-21-248 Conditional Judgment Against Defaulting Witnesses - Notice; When Made Absolute.
If a defaulting witness in a criminal case does not appear and explain the default, the clerk must issue notice and the sheriff must serve it; if the witness still fails to appear or excuse the default, the judgment becomes absolute.
