Section 2-2-4 Term of Office; Vacancy.

The commissioner serves a four-year term, starting on the first Monday after the second Tuesday in January after the election, and stays in office until a successor is elected and qualified. Vacancies are filled by the Governor for the rest of the term until a successor is elected and qualified.
