16-705 - Determination of delegates; vacancies; delegate bound to vote in accordance with pre-election statement; classification 16-705 . Determination of delegates; vacancies; delegate bound to vote in accordance with pre-election statement; classification A. The fifteen candidates who receive the highest number of votes shall be the delegates to the convention. B. If there is a vacancy in the convention caused by the death or disability of a delegate, or any other cause, the vacancy shall be filled by appointment by the majority vote of the delegates comprising the group from which the delegate was elected, and if the convention contains no other delegate of that group, shall be filled by the governor. C. Delegates elected upon a platform or nomination petition statement as favoring or opposing ratification shall vote at the convention in accordance with that platform or nomination petition statement, and upon an intentional failure to do so any such delegate is guilty of a class 2 misdemeanor, his vote shall not be considered, and his office shall be deemed vacant to be filled as provided by this article for filling vacancies.
