20-191 - Payment of premiums by mail; date of payment 20-191 . Payment of premiums by mail; date of payment A. Any payment of insurance premium that is deposited, properly addressed and postage prepaid, in an official depository of the United States mail on or before the date the premium is due is deemed timely payment of the premium on the date shown by the postmark or other official mark of the United States mail stamped on the payment envelope. An insurer may establish the postmark date by retaining the postmarked payment envelope. If the insurer does not retain the envelope or the postmark date on the envelope is illegible, the payment date is presumed to be five mail days before the date the insurer receives the payment. An insurer may establish the date of receipt by a record generated in the course of regularly conducted business. For the purposes of this subsection, "mail days" means days on which the United States postal service performs regular mail delivery. B. If a payment described in subsection A is sent by United States certified or registered mail or certificate of mailing, the date of the registration, certification or certificate, as established by a record authenticated by proper officials of the United States mail, is deemed the date of payment. C. If the due date of a payment described in subsection A falls on a Saturday, Sunday or legal holiday, the payment is considered timely if sent on the next business day. Â
