27-309 - Reports of fatal accidents to inspector; investigation 27-309 . Reports of fatal accidents to inspector; investigation A. When a fatal accident occurs in an operation, the operator shall give immediate notice thereof by telephone or facsimile transmission, and after investigation report the facts in writing to the inspector. The inspector, upon receipt of such notice shall instruct the operator as to preserving evidence of the accident. The inspector shall investigate and make a report which shall be filed in his office. B. If the inspector concludes the facts warrant it, he shall cause a copy of his report and all papers in his possession relating thereto to be forwarded to the county attorney of the county in which the fatal accident occurred, with an accompanying statement of the inspector, describing in what particular he believes the law has been violated.
