28-8468 - Airport zoning regulations; criteria; limitations 28-8468 . Airport zoning regulations; criteria; limitations A. Airport zoning regulations adopted under this article shall be reasonable and shall not impose a requirement or restriction that is not reasonably necessary to effectuate the purposes of this article. B. In determining what regulations it may adopt, a political subdivision and joint airport zoning board shall include the following in its consideration: 1. The character of the flying operations expected to be conducted at the airport. 2. The nature of the terrain within the airport hazard area. 3. The character of the neighborhood. 4. The uses to which the property to be zoned will be put and is adaptable. C. An airport zoning regulation adopted under this article shall not: 1. Require the removal, lowering or other change or alteration of a structure or tree that does not conform to the regulation when it is adopted or amended. 2. Otherwise interfere with the continuance of a nonconforming use, except as provided by section 28-8472.
