31-414 - Absolute discharge of parolee; effect; notice to victim 31-414 . Absolute discharge of parolee; effect; notice to victim A. If, upon application by the state department of corrections on behalf of a prisoner on parole, it appears to the board of executive clemency that there is reasonable probability that the prisoner on parole will live and remain at liberty without violating the law, and that his absolute discharge from parole is compatible with the welfare of society and is in the best interest of the state, then the board may authorize the absolute discharge of the prisoner from parole. On notification of the board's decision, the director of the state department of corrections shall issue to the prisoner an absolute discharge from parole which shall be effective to discharge the parolee from the sentence imposed. B. At least fifteen days before holding a hearing on the absolute discharge from parole of a parolee, the board on request shall notify the victim of the offense for which the parolee was incarcerated and inform the victim of his right to be present and to submit a written report to the board expressing his opinion concerning the absolute discharge of the parolee. The notice shall state the name of the parolee, the offense for which the parolee was sentenced, the length of the sentence and the date of admission to the custody of the state department of corrections.
