48-1726 - Appeal from final action of board on exclusion of lands; entry of final order of board 48-1726 . Appeal from final action of board on exclusion of lands; entry of final order of board A. Any person aggrieved by the final action of the board on a resolution of exclusion may file a written motion for reconsideration within ten days after adoption of the final resolution. Such person may appeal to the superior court of the county in which the lands are located within twenty days after consideration by the district board of the motion for reconsideration. The appeal shall consist of notice and a recital of the proceedings taken, the facts and matters involved, and the reasons why the appellant is aggrieved by the action of the board. B. The appeal shall be tried before the superior court of the county. The superior court shall have jurisdiction to hear, decide, adjudicate and make any and all necessary orders and judgments in the premises as in civil actions. There shall be no further appeal from the final judgment of the superior court. C. If a motion for reconsideration or an appeal is not taken within the time allowed, the final resolution shall be filed for record in the office of the county recorder and in the office of the board of supervisors and the county treasurer of each county in which the excluded lands are located.
