48-2949 - Exclusion of unproductive lands from district by resolution; notice 48-2949 . Exclusion of unproductive lands from district by resolution; notice A. When the board of directors of an irrigation district finds that lands within the district are alkaline, slick, unsusceptible of economic leveling, water-logged, caliche, hard pan or otherwise unproductive or incapable of carrying their proportionate district liabilities and obligations without recurring delinquencies, or are uncleared or unreclaimed for five years after inclusion within the district, for which irrigation water is available, and that the major portion of such lands has been unfarmed and delinquent in payment of district taxes for the last two years or more, it may exclude such lands as provided by this section and sections 48-2950 through 48-2952. B. The board shall adopt a resolution stating its findings and declaring its intention to exclude such lands for one or more reasons set forth in subsection A of this section, and shall require the record owner or any persons actually resident upon such land to show cause why the lands should not be excluded from the district. A copy of the resolution shall be served upon the record owners and actual residents, if any, upon the lands, personally if residents of the county in which the district office is located, or if not, by registered mail addressed to such persons at their last known post office address, and by publication of the resolution at least once a week for three successive weeks in a newspaper of general circulation within the county in which the district office is located.
