A city or town governing body may sell, lease, or grant surplus real property to the United States for governmental purposes, but it must give public notice, and sales over $50,000 need voter approval.
9-405 - Sale, lease or exchange of surplus property to federal government 9-405 . Sale, lease or exchange of surplus property to federal government A. Notwithstanding the provisions of section 9-402, 9-403 or 9-241, the governing body of a city or town may sell, lease or otherwise grant to the United States for governmental purposes any real property owned by it and surplus to its needs. The determination of the governing body that such property is surplus shall be final, and the property may be sold to the United States for such consideration as may be agreed upon between the governing body and officials of the federal government, including the exchange of land for land under the land exchange acts of the United States. B. Not less than ten days prior to the actual sale, lease or other disposition of such property, the governing body of the city or town shall cause to be published in a newspaper of general circulation within the county, or, if there is no such newspaper, then by posting in three public places within the county, a notice of the intent to dispose of the property, together with a description of the property and the terms and conditions of the proposed sale, lease or other disposition thereof. C. The sale shall be conducted without formalities, advertisement for bids or consideration of bids by other persons, but where the value of real estate proposed to be disposed of exceeds the amount of fifty thousand dollars, such sale, lease or exchange shall not be made unless first authorized by the voters of such city or town at a special election to be called and held in accordance with the provisions of section 9-403. D. Nothing in this section shall be deemed to affect the provisions of sections 28-8411 and 28-8414.
