Purpose and legislative effect
“This section says the act is called the Business and Professions Code.”
This part may be cited as the Real Estate Law. This section says chapter definitions apply only to this part, unless the text says otherwise. “Commissioner” means the Real Estate Commissioner. “Department” means the Department of Real Estate in the Business and Consumer Services Agency. This section says certain references like “bureau” and “Real Estate Division” mean the Department of Real Estate, and it states the section becomes operative on July 1, 2018.

Section 8805.
A repair or installation lien, or other right to keep equipment, does not exist if the total charges exceed the higher of the written estimate or a qualifying owner-authorized revision.
Section 9844.5.
The director may have chapter powers or duties carried out in the director’s name by a deputy director, assistant director, or chief, if the director sets conditions and limits.
Section 9882.3.
A person may not operate an official lamp or brake adjusting station unless the director has issued a license, and may not issue certain official adjustment certificates unless the issuer is a licensed lamp or brake adjuster.

Violating this chapter can lead to misdemeanor penalties, civil penalties, and lawsuits for injunctive relief or damages.
