Food and Agricultural Code, 1967

This section says the act is to be known as the “Food and Agricultural Code.”

If this code requires a notice, report, statement, or record, it must be in writing unless the code expressly allows it to be oral.

A person may not alter a record or document filed in a commissioner’s office under this code unless the commissioner or an authorized deputy approves it.

The department may establish and maintain tuberculosis control areas within this state.

When the department establishes a tuberculosis control area, the affected industry must be notified.

The State Veterinarian may authorize testing of cattle in a tuberculosis control area to identify animals affected with tuberculosis.

Owners of cattle in a tuberculosis control area must, when the department asks, provide facilities and help for tuberculosis testing.

Cattle entering a tuberculosis control area must meet requirements set by the State Veterinarian.

The State Veterinarian may impose a quarantine for a bovine animal that tests positive for tuberculosis or is found to be tuberculous on physical examination.

The value of a reacting bovine animal paid for by indemnity must be determined under Sections 9592 and 9593.

A reacting bovine animal must be slaughtered within 30 days after appraisal, and the slaughter must be supervised by the State Veterinarian.

Animals must be tested or slaughtered under this article even if indemnity funds are unavailable.

Slaughtering any reacting bovine animal under this article must be supervised by the department or the United States Department of Agriculture.

Carcasses from slaughtered animals must be disposed of according to department regulations or USDA meat-inspection rules.

If an animal is slaughtered under this article and indemnity funds are available, the owner may receive part or all of the listed proceeds and USDA-authorized payments.

Indemnity under this article must not be paid in the listed cases.

A later indemnity payment cannot be made unless the chapter has been fully complied with for each bovine animal added to the herd and the premises are kept in a sanitary condition acceptable to the department or USDA.
