Food and Agricultural Code, 1967

This section says the part applies to state and county institutions that are engaging in livestock operations, including fee payment provisions.

Certain poultry plants and poultry products are excluded from Chapters 1, 2, and 3 of Part 1 of Division 12 if they are subject to the plant sanitation and poultry meat product wholesomeness requirements in Chapter 4 of Part 3 of Division 9.

The director may make any necessary investigations into reported violations of this part.

The Attorney General may seek an injunction in superior court for violations of this part or director-issued regulations; if the director complains and the required belief of a violation exists, the Attorney General must act, and the director does not have to plead certain damage/remedy facts.

The director may adopt regulations setting poultry inspection-related standards and requirements, and may make cooperative agreements with U.S. agencies to enforce them.

Regulations adopted under this article, Section 24681, or Section 24991 should, as far as practicable, match USDA rules and standards for inspecting, preparing, and processing poultry meat and poultry meat food products.

If poultry slaughtering, carcass preparation, or processing happens during overtime inspection hours or on legal holidays, the owner or operator must arrange with the department to cover the extra inspection costs. Collected money must be deposited in the Department of Food and Agriculture Fund.

The definitions in this article control how this chapter is read, unless the context requires otherwise.

“Fowl” includes chickens, turkeys, ducks, geese, and other domesticated birds.

“Growing poultry” means feeding and caring for poultry.

“Marked” means poultry meat must be labeled or otherwise marked so it clearly shows the required name and address information.

This section defines “mislabel” as using or having any false, deceptive, or misleading mark, tag, brand, design, statement, invoice, placard, sign, or similar description.

This section defines “New York dressed fowl.”

This section defines “poultry” as domesticated fowl and domesticated rabbits intended for human food.

“Poultry meat” means the carcass of poultry, or any part of that carcass.

This section defines “poultry plant” as certain places where poultry is slaughtered or processed for human food, with an exception for retail stores or eating places in one part of the definition.

This section defines “producer” for poultry: a person growing poultry marketed as poultry meat for at least three weeks to increase its size and weight.
