The total amount of bonds issued for the district cannot exceed 15% of the district’s taxable property.

The bonds’ term must not exceed 40 years.

The bonds must be payable in lawful money of the United States for both principal and interest.

The board of supervisors may choose where bond principal and interest are paid, including certain treasurer offices or another place it designates, and the bonds must state the payment place.

Bonds must be sold at the times and in the amounts set by the board of supervisors, and not for less than par.

Before selling any bonds, the board of supervisors must advertise for bids in the specified newspaper.

If satisfactory bids are received, the bonds must be awarded to the highest bidder. If no bids are received, or the board of supervisors finds the bids unsatisfactory as to price or bidder responsibility, the board may reject all bids and re-advertise or sell the bonds at private sale.

Bond sale proceeds must be deposited in the principal county treasury to the credit of the district’s improvement fund, and they may be withdrawn only for the purposes for which the bonds were voted.

This section defines “pipeline corporation” and excludes certain landfill-gas pipeline operators from that definition.

If bonds are still unsold six months after being offered for sale, the district’s board of directors may ask the board of supervisors to withdraw them from the market and cancel them.

After receiving a petition signed by a majority of the board of directors, the board of supervisors must set a hearing time, and the hearing must occur within 30 days of receiving the petition.

The board of supervisors must publish a notice about the hearing and the petition.

The board of supervisors must hear objections or support for the petition, and if it decides cancellation is in the district’s best interest, it must record an order canceling the unsold bonds.

A district may borrow money and issue revenue bonds for authorized public improvements, subject to this article.

Revenue bonds under this article must be authorized, issued, and sold under the Revenue Bond Law of 1941.

“Railroad” is defined to include many kinds of railways and related facilities, but not a street railroad.

In this chapter, “board of supervisors” means the board of supervisors of the principal county.

If district revenues are not enough to cover bonded debt payments or other district expenses or claims, the board of directors must send a written estimate of the minimum money needed to the board of supervisors and county auditor.

The board must send the estimates to the board of supervisors and the county auditor at least 15 days before the first day of the month when taxes must be levied for county purposes.

After receiving the estimates, the board of supervisors must levy annual taxes for the airport district: one to pay bond principal and interest, and one to pay the district’s other expenses and claims.

The bond tax must be enough to pay bond interest and the part of principal due each year.

Bond-tax proceeds must be deposited in the principal county treasury, credited to the district interest and sinking fund, and used only to pay principal and interest on the bonds.

An airport district’s tax rate for any one year cannot be more than $0.20 per $100 of assessed valuation, excluding the bond tax.

Bond and district taxes must be levied on taxable property in the district, collected by the principal county tax collector, and paid to the district.

A district may impose a special tax, but the tax must be applied uniformly, with unimproved property allowed to be taxed at a lower rate than improved property.

“Railroad corporation” means a corporation or person that owns, controls, operates, or manages a railroad for compensation within the state.

For telephone corporations, “service area” means a local access and transport area approved in the referenced federal court case and order.

This section defines “sewer system” broadly and excludes a system that only collects sewage on one owner’s property.

“Sewer system corporation” means a corporation or person that owns, controls, operates, or manages a sewer system for compensation within this state.

“Street railroad” is defined to include certain railways and related property, but not commercial or interurban railways.

This section defines “street railroad corporation.”

This section defines “telephone line” broadly to include equipment, fixtures, property, and facilities used to communicate by telephone.

This section defines “telephone corporation” and sets out two exclusions from that definition.

This section defines “telegraph line” broadly to include related equipment and property used to support telegraph communication.

This section defines “telegraph corporation” to include any corporation or person that owns, controls, operates, or manages a telegraph line for compensation within this state.

This section defines “toll-bridge corporation” to include private corporations or persons that own, control, operate, or manage a bridge or related appurtenance used to transport people or property for compensation in this State.

This section defines “transportation electrification.”

This section defines “vessel,” creates two transportation-related exemptions, and requires certain carriers to apply for a certificate and pay a $50 fee by March 1, 1994.

This section defines “VoIP” and “Internet Protocol enabled service” for the code.

This section defines “water system” broadly to include listed facilities and property used to move, store, supply, distribute, sell, or measure water for the stated uses.

This division may be known and cited as the Riverside County Transportation Sales Tax Act.

The Legislature states that alternative transportation financing methods are needed for Riverside County and that the County and its transportation commission should receive support to implement local transportation improvements.

“Bonds” is defined to include indebtedness and securities of any kind or class, including bonds, notes, bond anticipation notes, and commercial paper.

“Commission” means the Riverside County Transportation Commission created under Section 130054.

“County” means the County of Riverside.

The commission must spend only necessary and reasonable funds for specified administrative purposes, and it may not spend more than 1% of certain tax revenue on staff salaries and benefits.

The commission must adopt an annual budget, arrange at least annual postaudits by a certified public accountant, and do whatever is necessary to carry out this division’s purposes.

The commission must publish notice of the public hearing for adopting the annual budget at least 15 days before the hearing, and the proposed annual budget must be available for public inspection at least 15 days before the hearing.

The commission may approve a transaction and use tax ordinance and ballot proposition and call an election, if it follows Chapter 4 beginning at Section 240300.

The commission may sue and be sued in competent courts and tribunals, unless another law provides otherwise.

Claims for money or damages against the commission are governed by Government Code Division 3.6, unless that division or other expressly applicable statutes or regulations provide otherwise.

The commission may make contracts and enter into stipulations, including to indemnify and hold harmless, employ labor, and do acts necessary and convenient to exercise its powers.

The commission may enter into contracts with U.S. agencies, public agencies, or private persons on terms it finds to be in its best interest.

Government agencies must keep committing local funds to street, highway, and public transit purposes, as enforced by a commission ordinance.

The commission may levy a retail transactions and use tax, but the ordinance needs commission and voter approval and must limit administrative staffing use to no more than 1% of annual net tax revenue.

The commission must set out key tax details in the ordinance and include an expenditure plan with required revenue-allocation details.

The county must conduct the election, and it must be called and run the same way county elections are generally conducted by law.

A transactions and use tax ordinance becomes operative more than 120 days after adoption, and before that date the commission must contract with the State Board of Equalization to handle administration and operation.
