No more than 3% of the money deposited in the subaccount may be used for the listed purposes.

The department may give grants to local agencies to fund feasibility studies for projects that may qualify for loans under Section 79163.

This section defines “account” for this chapter as the Water Supply, Reliability, and Infrastructure Account created by Section 79166.

This section creates the Water Supply, Reliability, and Infrastructure Account and transfers $630,000,000 into it from the fund.

The Legislature states that managing surface water and groundwater together is an effective way to improve water supply reliability for all sectors in California.

If the Legislature appropriates the subaccount money to the department, the department may use it for grants for feasibility studies, project design, or construction of conjunctive use projects.

When approving projects under this article, the department must give priority to projects with eligible third-party funding and consider several listed project factors.

An applicant that is not a local agency must carry out a conjunctive use project with a local agency’s participation to qualify for funding. The department or a local agency may also provide assistance if the participating local agency asks for it.

A construction project cannot receive more than $50 million from the subaccount.

No more than 5% of money deposited in the subaccount may be used for administration costs of this article.

At least 40% of the money deposited in the subaccount must be spent on studies, projects, and facilities in watersheds of the central valley.

Projects under this article must protect groundwater and water rights, and funding is barred unless the department makes a required design-and-operation finding.

The department must consult an advisory committee when carrying out this article and awarding grants. Committee members with a conflict involving a grant applicant must disclose it and must not review that applicant’s grant application.

The department may adopt regulations to carry out this article.

This section defines several terms used in the Bay-Delta Multipurpose Water Management Program article.

This section says the article does not limit any agency’s authority under other law to spend funds for the article’s purposes.

The Legislature states findings about the CALFED Bay-Delta Program and says the state should participate in funding eligible projects.

This article does not authorize implementation of the CALFED Bay-Delta Program or any part of it.

This section creates the Bay-Delta Multipurpose Water Management Subaccount in the account.

$250,000,000 is transferred from the account to the subaccount.

The department may use subaccount money for eligible projects after legislative appropriation, and it may reallocate unspent eligible-project money. The funds cannot be used until required annual consultation has occurred.

Funds appropriated under Section 79196 must be allocated to six listed project purposes in specific dollar amounts.

Funds in the subaccount may not be spent until specified state and federal environmental approval steps are completed.

The state must, to the greatest extent possible, secure federal and nonfederal funds to implement this article.

The Secretary of the Resources Agency must review schedule adherence each year and, if needed, prepare a revised schedule before funds can continue to be spent.

The Secretary of the Resources Agency must submit an annual report to the Legislature by December 15 each year.

The report under Section 79200 must include a summary of project results and any needed project modifications.
