65-5732. Kansas right-to-know fee fund, creation of; secretary of health and environment; administration and uses of fund. (a) There is hereby created in the state treasury the Kansas right-to-know fee fund, which shall be administered by the secretary of health and environment. All moneys received pursuant to K.S.A. 65-5704, and amendments thereto, shall be deposited into the Kansas right-to-know fee fund. (b) All expenditures from the Kansas right-to-know fee fund shall be used by the secretary of health and environment to: (1) Administer the Kansas right-to-know program; (2) provide and maintain the reporting system necessary to comply with K.S.A. 65-5704, and amendments thereto; and (3) provide training to owners or operators of Kansas facilities, Kansas first responders and Kansas emergency management officials on the existence, access and use of the reporting system established pursuant to the Kansas emergency planning and community right-to-know act. (c) All expenditures from the Kansas right-to-know fee fund shall be made in accordance with appropriation acts upon warrants of the director of accounts and reports issued pursuant to vouchers approved by the secretary or by a person or persons designated by the secretary.
