§248. Surviving spouses of police officers A. Any local retirement or pension system, plan, or fund may grant a cost-of-living adjustment to any surviving spouse currently receiving death, surviving spouse, or widows' benefits based on the death of a spouse who was a police officer, provided that: (1) The death occurred while the officer was in the discharge of his duties, or resulted from immediate effects of an injury received while he was engaged in the discharge of his duties; (2) The death occurred on or before January 1, 1960; and (3) The surviving spouse is at least eighty years of age on July 1, 2006. B. The increase granted pursuant to the provisions of this Section shall not be more than four hundred dollars per month. Acts 2006, No. 649, §1, eff. July 1, 2006.
