State agencies that propose elderly programs or services must consult the office/department, and the office/department must review, report on, and comment on those proposals; state agencies affecting elderly health or well-being must cooperate.
§935. Power of review of proposals of state agencies NOTE: Subsection A eff. until one or more of the 20 depts. of the executive branch is abolished or a const. amend. authorizing the creation of an additional dept. becomes effective, whichever is earlier. See Acts 2013, No. 384, §§5 and 9. A. Any state agency or department proposing to establish, modify, or expand programs or services for the elderly of the state shall consult with the director of the office, who shall consult and coordinate a response with the parish voluntary councils on the aging as appropriate. NOTE: Subsection A as amended by Acts 2013, No. 384, §5, eff. when one or more of the 20 depts. of the executive branch is abolished or a const. amend. authorizing the creation of an additional dept. becomes effective, whichever is earlier. B. The department shall review and report upon all such proposals submitted to it and shall comment as to the following: (1) The relationship and impact of the proposal on existing programs affecting the elderly. (2) The impact of any proposed legislation, regulation, or order upon the elderly. (3) Recommendations as to (a) the desirability of the proposal and (b) modifications that would enhance the positive impact of the proposal upon the elderly or aid in the implementation of the proposal. NOTE: Subsection C eff. until one or more of the 20 depts. of the executive branch is abolished or a const. amend. authorizing the creation of an additional dept. becomes effective, whichever is earlier. All state agencies administering programs or implementing policies which affect the health or well-being of the elderly shall cooperate with the office in carrying out these responsibilities.
