The Department of Public Safety and Corrections must support parole administration, gather and share offender information, compile program data, and submit an annual report. The department secretary must establish program regulations.
§574.3. Personnel and reports to be furnished by the Department of Public Safety and Corrections to the committee on parole; reports to be provided to the Board of Pardons; intensive incarceration and intensive parole supervision program data compilation; annual report A. The Department of Public Safety and Corrections shall provide the necessary clerical and administrative personnel, equipment, office space, and facilities for the committee on parole and its members. B. The Department of Public Safety and Corrections shall see that every offender is interviewed and explained the rules with respect to release on parole. It shall secure all relevant data and shall assist the offender in formulating a parole plan. Whenever the committee orders a parole hearing to be held, the Department of Public Safety and Corrections shall secure a report with respect to the personality of the offender, his social history, his adjustment to authority, the physical, mental, or psychiatric condition of the offender when such information is available, and his prison record, and may include any recommendation with reference to the release of the offender on parole. C. In an application for pardon or commutation, the Department of Public Safety and Corrections shall provide the board of pardons and the governor with such records of the facts and circumstances of the offense for which the offender was confined, the offender's past criminal record and his social history, the prison record, the physical, mental, or psychiatric condition of the offender, and any other records or other reports that may be requested. D. The department shall compile statistical data to document successful program completions and program failures by offenders assigned to the intensive incarceration and intensive parole supervision program. The department shall utilize the statistical data to evaluate the operation of the program, define policies, and formulate eligibility standards. The secretary of the department shall establish regulations for the administration of the intensive incarceration and intensive parole supervision program. E. The department shall prepare and submit an annual report to the legislature and to the governor, which shall include the following: (1) An overall assessment of the intensive incarceration and intensive parole supervision program. (2) An evaluation of the extent to which program goals and objectives are being met. (3) A statement regarding the fiscal impact of the program. Acts 1968, No. 191, §1.
