§ 784Forfeiture for violationsProvision

Violating this subchapter is a civil violation with a minimum $200 fine. For minor violations, the commissioner need not sue or issue an order if a written warning better serves the public interest, and the commissioner may instead issue that warning. The commissioner may also seek a temporary or permanent injunction to stop violations.

Any person who violates any provision of this subchapter commits a civil violation for which a fine of not less than $200 must be adjudged. This subchapter may not be construed to require the commissioner to sue or to issue an order as a result of minor violations of this subchapter, when the commissioner believes that the public interest will best be served by a suitable written warning. In such a case the commissioner shall issue a written warning. [RR 2021, c. 1, Pt. B, §110 (COR).] The commissioner may apply for a temporary or permanent injunction restraining any person from violating or continuing to violate this subchapter, notwithstanding the existence of other remedies at law. The injunction shall be issued without bond being required of the State. [PL 1979, c. 491, §1 (NEW).]
