This section sets penalties for violations, including a civil penalty of up to $1,000 per violation and per day, misdemeanor treatment for certain record-related evasion conduct, and the same penalty for knowing aiders or abettors.
259.200. Penalties. — 1. Any person who violates any provision of this chapter, or any rule, regulation, or order of the council shall be subject to a penalty of not more than one thousand dollars for each act of violation and for each day that such violation continues, unless the penalty for such violation is otherwise specifically provided for and made exclusive in this chapter. 2. If any person, for the purpose of evading this chapter, or any rule, regulation, or order of the council, shall make or cause to be made any false entry or statement in a report required by this chapter or by any such rule, regulation, or order, or shall make or cause to be made any false entry in any record, account, or memorandum required by this chapter, or by any such rule, regulation, or order, or shall omit, or cause to be omitted, from any such record, account, or memorandum, full, true, and correct entries as required by this chapter, or by any such rule, regulation, or order, or shall remove from this state or destroy, mutilate, alter or falsify any such record, account, or memorandum, such person shall be guilty of a misdemeanor and upon conviction shall be punished as provided by law. 3. Any person knowingly aiding or abetting any other person in the violation of any provision of this chapter, or any rule, regulation, or order of the council shall be subject to the same penalty as that prescribed by this chapter for the violation by such other person. 4. The penalties provided in this section shall be recoverable by suit filed by the attorney general in the name and on behalf of the council, in the circuit court of the county in which the defendant resides, or in which any defendant resides, if there be more than one defendant, or in the circuit court of any county in which the violation occurred. The payment of any such penalty shall not operate to legalize any illegal oil, illegal gas, or illegal product involved in the violation for which the penalty is imposed, or to relieve a person on whom the penalty is imposed from liability to any other person for damages arising out of such violation.
