§ 150B-25. 1. Burden of proof.

In a contested case, the petitioner usually must prove the facts alleged in the petition. In civil fine or penalty cases brought by a State agency, the agency must prove the violation. For a career State employee case, the agency employer must prove just cause for discharge, suspension, or demotion.
