§ 143-215. 10E. Violations requiring immediate notification.

(a)Any employee of a State agency or unit of local government lawfully on the premises and engaged in activities relating to the animal operation who observes any of the following violations shall immediately notify the owner or operator of the animal operation and the Division: (1)Any direct discharge of animal waste into the waters of the State. (2)Any deterioration or leak in a lagoon system that poses an immediate threat to the environment. (3)Failure to maintain adequate storage capacity in a lagoon that poses an immediate threat to public health or the environment. (4)Overspraying animal waste either in excess of the limits set out in the animal waste management plan or where runoff enters waters of the State. (5)Any discharge that bypasses a lagoon system. (b)Any employee of a federal agency lawfully on the premises and engaged in activities relating to the animal operation who observes any of the above violations is encouraged to immediately notify the Division.
